Why would he be arrested, I don't think all states specifically say you can't.
Though there was a guy that got cornered after he speared a black bear some years back, a very gray area as to legality.
OF course the black bear was open land, not a fence and the guy worked hard on his methods and spears. More power to folks like that. AGain its not different in my mind than you using a 270 and me choosing a 338, simply a different choice of weapons.

What if you chose a .338 and I decided on a .22? be fine with me, if you stick to spearing distance....

Guys were spearing black bear in NE MN for a while; no fences. They used very-long handled spears out of tree stands. They just jabbed the bear; didn't throw it. The state made spearing bear illegal shortly after. I tried spearing deer a couple of times. They ran at the start of my throwing movement. I never had a chance. Those Cold Steel spears are pretty tough. When the local warden (a friend) found out about it, he laughed pretty hard; thought my efforts were pretty funny....and futile. He was right.

I wouldn't hesitate to use a 22 under the right set of circumstances.... put more than one cow/bull down with a 22 over the years. That or a 45 acp.
I think I DID mention something about legal, and a quick humane death... if a spear does that, fine with me. I'd still love to get a hog with one and I suspect it'll happen at night before I 'm dead and gone and I"ll have a grin too...

Shooting an elk with a .22 would be illegal in any place I ever lived. There is usually a minimum energy rule in place.....all of which is mute if it is a high fence livestock sitation. I too have killed 1000 lb steers with a .22, not really relivent here.

Amen. I'm guessing that spear makes a damn site bigger hole than your average arrow/broadhead combo. As long as he's practiced enough to hit what he's throwing at, go for it.

Animals aren't personal playthings one gets to exercise one's ego on... throwing a spear at an elk is so irresponsible on so many levels it's hard to know where to start.
What's next, hurling rocks on animals to mimic our cave-dwelling ancestors? Maybe we could drive a herd off a buffalo jump.
Encouraging something so iffy is so far beyond me I can't fathom how anyone could participate in such a stunt, let alone promote it as "sport" to other knuckle-draggers, all to make a buck...
So no, my objection has far less to do with the high fence... which is fairly disgusting in its own right. By that logic, no one should be allowed to hunt with anything but the most modern scoped bolt action rifles. What about the guys that enjoy the challenges of iron sights? They aren't using the most effective killing machine. Does that make them unethical? What about real muzzleloaders? Is that stepping too far done the technology chain? How about handguns? Surely compound bows (not to mention traditional archery equipment) must be over your line? Once you start down that slippery slope of mine is OK, but yours isn't, where do you draw the line?
