My motive for the post was to show there was an option to hold Lerner accountable for what she has done. We all know the AG won't lift a finger. We all saw the contempt he had for Rep. Gohmert yesterday. He is an arrogant sack of feces. This man doesn't deserve to occupy that office, among others. We are fast approaching a variety of Constitutional crises that could spin out of control. Whether the House will act on this provision, time will tell. But at least there is an option.

As I understand it, the courts need not even be involved in jailing someone for contempt of Congress. The normal path is to refer the matter to the courts for independent handling, but as I read it, houses of Congress have authority in their own right to enforce their subpoena power.
If that's correct, then the House can jail Lerner for lying to them and obstructing their investigation. They can't jail her for other offenses. As I've read it, the courts have upheld what you say. The House as a body has the right to imprison people for contempt just as a judge can without needing any grand juries or US Attorney or the DOJ, but it's extremely limited in regards to seeking testimony or evidence in regards to matters in which it has Constitutional oversight. It's used very rarely, and has never been used on a Cabinet member such as Holder. In regards to Lerner, you have a DOJ that is going to refuse to prosecute (I believe), but you also have a legal question of whether she actually voided her 5th Amendment privileges with her testimony. In my opinion, the House should jail her and let the legal questions be answered later in court because that's the only way it will ever get to court.

none of which will happen. If Johnny Boehner et. al. refuses, then we have entered into a new paradigm and the Constitution will have been defeated. All the more reason to pay attention get involved and kick out the RINOS asap. At some point in the not too distant future, there will be a breakdown of authority the likes we have never seen - only in other countries.

By comparison, the riots/police clashes in Ukraine will look like a church's ice cream social..
