I am surprised that the decision on the death penalty is down to the jury..Surley the jury should simply determine guilty/not guilty and then leave it to the Judge to determine the sentence?

Pete: It might vary state to state, but in a First Degree Murder Trial, if the defendant Is found guilty, it goes back to the jury (at least here in Florida) for the death sentence recommendation and I also believe it must be unanimous.

Isn't this a Federal case? Would it matter which state he's tried in?

Correct, MM, and I don't know what the Fed regulations are. We have plenty of lawyers here, so maybe they'll chime in.

I presume its to avoid some guilty scum bag getting off scot free because a jury member would not convict if there was a mandatory death penalty?? It�s a shame because the majority of these scum bags really do deserve to die for their crimes..
