If any of the people whose communications were intercepted file a lawsuit for Constitutional rights violation(s), all of that will become Discovery, and anyone involved in the investigation will be a defendant. Watching him last summer when Shifty started lying about him on national TV, you could tell that he was a man on a mission. Bowing out for that 2=3 month period was a very wise move on his part.
