You have to believe he is the perp, but there are several things that make one wonder, now. The prosecutors are upset there is a second attorney appointed to represent him and call it stacking the deck??? Just maybe he is not guilty?

KODIAK, Alaska (AP) - A new trial date has been set for a man convicted in the 2012 killings of two co-workers at a Coast Guard communications station in Alaska.

The Kodiak Daily Mirror reports James Wells is scheduled for trial April 29 in Anchorage.

The new date comes nearly a year after a federal appeals court panel concluded Wells did not receive a fair trial. The three-judge panel reversed Wells' conviction on murder and weapons charges and ordered a new trial.

Members of the panel took issue with the government challenging the appointment of a second attorney to help represent Wells, saying it carried a "reproachable air of stacking the deck."

The panel also found the lower court erred in permitting the use of certain testimony.

The gov saying that the defense stacked the deck because he added a second lawyer seems a bit ludicrous IMO, why would the gov care how many lawyers he has on his team? Is their case that weak?

Yeah, no schitt. The govt has no problem assigning a platoon of lawyers go after someone.

CG front gate camera is compelling, shows him going/coming at the right times, though he claimed he had a flat and never came in that morning. , faced with that evidence, changed story....claimed he used restroom at Servant air (all there said no way), vs restroom at terminal which has surveillance cameras.... a "loaned" .44 magnum is the only gun he can't produce.... If he does get off I would not want to be him ever returning to Kodiak even for a day.

No but it illustrates the ways in which one obvious suspect can get convicted of a crime he didn’t commit. I’m not saying that’s the case here but It also illustrates how sleazy and unethical the DA and prosecutors often are, being an ends justify the means irregardless of the truth. Denying Wells the opportunity to bring on another lawyer when the state has unlimited (and often corrupt) resources at their disposal was stupid and it’s hardly an unusual or extraordinary request in light of the charges.......especially if innocent until proven guilty is still a presumption in our country but with the way we ignore the constitution I fear it’s been lost.
I’m only passingly familiar with the case but the state withholding evidence or obscuring its discovery doesn’t make them the good guys, especially if the evidence is against him is sound then having the prosecution open themselves up for such stupid objections as to warrant a new trial isn’t the hallmark of professionals, it’s usually a good indication of bumbling fools that are over their head.
