This thing is going crazy on FB, looks like someone could lose thier job as she should. Alaska State Commission for Human Rights 11 hrs · Earlier today we posted a sticker that we read as racist that read "Black Rifles Matter." It offended many gun owners who felt we were against the second amendment and the right of citizens to own guns. Please know that is not the case. Our concern was with the connotation of the statement to the Black Lives Matter movement. We know some of you were offended by the post so we removed it.

Yep- now there is a department ripe for Dunleavey's hatchet. Seems to me one employee would be plenty. Assuming that one person actually did some work other than cruising the parking lot looking for something to be "offended" by.
Both these yo-yos should be terminated.
Didn't Dunleavey demand resignations from all appointed state employees at that level? Dust 'em off and activate!

And I found this on that article from MustReadAlaska. Governor Mike Dunleavy 3 mins · After review of a post made on the Alaska State Commission for Human Rights social media page yesterday, my office has requested the Department of Law launch an immediate investigation into the matter. Protecting an individual’s constitutional rights, including the 1st amendment, is of the utmost importance to this administration.

Would have posted this earlier but was on a tablet... https://www.ocregister.com/2007/06/27/buscaglia-will-not-join-register-as-new-publisher/Buscaglia will not join Register as new publisher Marti Buscaglia By ORANGE COUNTY REGISTER June 27, 2007 at 3:00 am Marti Buscaglia will not become the Orange County Register’s new publisher because she misrepresented her educational qualifications on her resume, said N. Christian Anderson, current publisher and president and chief executive of Freedom Orange County Information. Buscaglia’s resume listed graduation from Lima University in Peru. She has been publisher of the Duluth News Tribune in Minnesota for five years. She was slated to join the Register on July 9. Anderson said the company had received Buscaglia’s resume from executive recruiters when she was considered for other jobs within Freedom Communications Inc. the Irvine-based nationwide media chain that includes the Register. Anderson and Buscaglia declined today to say how the misrepresentation came to light. “I take full responsibility for it,” Buscaglia said in a phone interview. “It’s one of those things you put on a resume when you are young and stupid and you can never take it back.” Anderson said, “I regret the information came to light after we had announced Marti’s appointment (on June 6) that precludes our being able to move forward with this decision. “Credibility is a hallmark of Freedom and our products,” he continued. “We agreed that this breach would make it impossible for her to fulfill her responsibilities.” Anderson has been publisher of the Register for eight years and had hired Buscaglia for that role so that he could concentrate on interactive media, specialty publications and commercial printing services for Freedom Orange County Information, the umbrella division that includes the newspaper group. All are part of Freedom Communications. Hiring a new publisher was intended to be part of a company-wide initiative to respond to the rapidly changing media environment as newspaper circulation declines and readers turn to the Internet and other sources for information. Anderson will continue as Register publisher but “it would make sense for us to look for another publisher,” he said.

Doing a quick check on the other card finds something interesting... head of 54 staff positions. Guess I find it more telling than interesting in light of the stories from friends of mine working under him. Things like the guard that gave Israel Keyes a razor and did not follow up on it was not reprimanded in any way, yet an officer that made his rounds and failed to notice Keyes cutting and strangling himself under the covers did. Care to guess which was a person of color? Care to guess the general attitude of many guards I know? Yes, I get it that Probation and Prison Guard is not the same position, but how likely is it the entire system is as rotten as any particular section? http://www.correct.state.ak.us/probation-paroleHOME ADMIN SERVICES COMMISSIONER INSTITUTIONS PRETRIAL REENTRY PAROLE BOARD PROBATION & PAROLE HEALTH & REHAB SERVICES CONTACT State of Alaska > Department of Corrections > Probation & Parole PROBATION AND PAROLE The mission of the Division of Probation and Parole is to enhance community safety. Things got a lot more real for old Marti... She thinks she gets to seek out and eliminate anyone's speech? And that bumper sticker could possibly rise to the level of hate speech? I suspect I know what really happened, but this is just a WAG, so it must be true... the two were likely a little buzzed coming back from a romantic two-martini lunch and thinking with hormones and Kendall had to go and act all offended and the situation got away from them. Remember, you read it here first... https://www.apnews.com/e551fbcc167b4c95a6e8440b7a23fd64Click to copyhttps://apnews.com/e551fbcc167b4c95a6e8440b7a23fd64 Alaska Business Gun politics Social media post over rifle sticker in Alaska causes uproar By BECKY BOHRER today JUNEAU, Alaska (AP) — A social media post by an Alaska human rights official questioning the appropriateness of a sticker on the back of a truck reading “Black Rifles Matter” has caused an uproar, with Gov. Mike Dunleavy calling for an investigation. Marti Buscaglia, executive director of the state Commission for Human Rights, said the truck was parked outside the commission’s building in Anchorage. She said she thought the sticker was racist and posted a picture Thursday on the commission’s Facebook page asking, “In what world is this OK?” Buscaglia said she used her business card to write a note that was placed on the truck, hoping the owner would call her. The note asked that the truck with the “offensive” sticker not be parked in the lot. Brent Linegar said when he found the note on his truck he chalked it up to people having opinions. But he said he was bothered when he learned of the post on the commission Facebook page, which he felt maligned him. Linegar had understood the stickers, which are on several of his trucks, to be about gun safety and “Second Amendment awareness,” he said. “I was like, man, I can’t let that slide,” he said. Linegar, who has a plumbing and heating business, posted a picture of the note on his Facebook page and asked if he was missing something: “I thought this sticker was a pro-second amendment statement? Someone tell me if I’m completely wrong!” He also said there was an email calling the sticker racist. In an interview Friday, Linegar, who said he had been doing general repairs at the building, said Buscaglia wrote the building owner asking that the company be banned from the property.
Buscaglia acknowledges writing an email but said it included a number of complaints about Linegar or his employees. Buscaglia said she told the owner, who wasn’t sure how to respond, that they could hire a different heating and air company.
The commission’s Facebook page has been inundated with comments. Buscaglia took down the initial post, writing on Facebook that it offended many gun owners who saw the post as the commission being against the right to own guns. “Please know that is not the case,” the new post read. “Our concern was with the connotation of the statement to the Black Lives Matter movement.” Buscaglia said the commission’s aim is to seek out and eliminate discrimination, and she considered the sticker to be a discriminatory statement. She said she never intended to step on anyone’s constitutional free speech or gun rights.“I think the line between being protected by the First Amendment and hate speech is very fine,” she said. “And frankly I wasn’t sure which one this was.”She said, in hindsight, she could have worded the initial post differently. She shared on the commission’s Facebook page Friday Dunleavy’s statement calling for an investigation. She said in an interview that she will cooperate. Dunleavy spokesman Matt Shuckerow said by email that a “thorough, fair and impartial investigation is being conducted to ascertain all relevant facts that surround this matter.” Linegar said he considered the situation hurtful and inappropriate and hoped state officials would “make it right.”

I’ve been following this since last night. Dunleavy just opened an investigation into it. I like the comments about how black guns matter is racist, that is until it’s pointed out that the founder is black. Gets real quiet after that. It’s my understanding that the ‘Black Rifles Matter’ slogan originates with Linc Sample of Boothbay Harbor, ME.

I would think old Marti would confine herself to responding to concerns of human rights violations, not applying her own interpretation on a truck sticker.
By the way, I first saw this on Facebook, shared by an outfitter in South Africa. This thing has some reach.

Arrogance will get you every time. Ol boy was thinking with his Dick.. just like that enjoying a high paying state job. Too hey you might want to start looking for another job buddy. Ol girl got comfortable hanging out with her peeps, you know berkowitz, begich supporters and figured everyone would side with her. Just like people do in Portland, Seattle, San Francisco.. now she is probably going to be out of a job, leaving the cards were bad enough but the nail in the coffin calling the building owner and telling him to get a different contractor gd.

HAR!
Some people LIVE to be offended. Now we're getting somewhere. That would 'splain why the sticker is raciss! The folks I know that know him do not have a good word to say about him. They suggest he exceeded his skill set several promotions ago. Soooo...He should change his name to Peter, just on "principle" eh?

Seems like in a state like Alaska where the vast majority of its citizens enjoy outdoor pursuits of hunting and fishing that they really need to tell the Governor to clean his own house.... and get of biased employees like that.

Lots of talking but the Gov's office has not said anything publicly yet. The whole Human Rights Commission is ridiculous and redundant and needs to go. https://mustreadalaska.com/human-rights-commission-director-was-regulating-hate-speech/Human Rights Commission director was regulating ‘hate speech’ MARTI BUSCAGLIA DIGS DEEPER THE MORE SHE EXPLAINS HERSELF Pro-tip for Marti Buscaglia: She may want to just stop talking to the press. She’s not making it better and now that there’s an official investigation into her conduct, it’s time for her to just clam up for a bit. In fact, taking a quick vacation to Hawaii would be advisable. Buscaglia, the executive director of the Alaska Human Rights Commission told a reporter on Friday that she simply wasn’t sure: Was the “Black Rifles Matter” truck decal free speech or hate speech? Since she wasn’t sure, she took action to regulate it as hate speech in a parking lot on A Street that is leased by the State. Buscaglia left her calling card — her official business card showing the authority vested in her by the State of Alaska — on the truck belonging to Brenton Linegar, who owns a small plumbing firm that had a contract to do repairs on the building. It was a heavy-handed message to a private citizen to get off the parking lot of the State of Alaska. Buscaglia, whose agency has an official Facebook page, then took a photo of the back of the truck and decal and posted it on Facebook with a provocative comment meant to shame the truck owner: “In what world is this OK?” she wrote. Under the Seal of the State of Alaska, Buscaglia was doxxing the owner of the truck — publicly shaming him on Facebook. That wasn’t enough for her. She decided to hurt his business by sending an email to the owner of the building asking him to ban the plumbing company from doing work. Buscaglia — or her staff — felt the immediate backlash from Alaskans on Facebook, and the sting of their comments led her to remove the post from the official State page. She offered an explanation that “it offended many gun owners who felt we were against the second amendment and the right of citizens to own guns. Please know that is not the case. Our concern was with the connotation of the statement to the Black Lives Matter movement. We know some of you were offended by the post so we removed it.” Buscaglia was showing her confusion: Gun owners on Facebook weren’t offended by the agency’s action due to the Second Amendment. It was the First Amendment they were concerned about. After all, this is a state agency with a mission of enforcing fines and penalties on people for their behavior. The agency had, on Thursday, suddenly expanded its mission from regulating behavior in hiring and housing to regulating speech on public property — a massive scope expansion. [Read: Human Rights Commission vs. First, Second Amendment] As the Human Rights Commission public relations nightmare started blazing, Buscaglia’s phone started to ring. By Friday, the news media had taken notice. She told the Associated Press: “I think the line between being protected by the First Amendment and hate speech is very fine. And frankly, I wasn’t sure which one this was.” HATE SPEECH A NEW REGULATORY AREA FOR THE HUMAN RIGHTS COMMISSION? The U.S. Supreme Court has, on multiple occasions, shown that whatever hate speech is — and that is an elastic term — it’s protected by the U.S. Constitution. The Court has said, at least six times in recent years, that even offensive speech is protected. Those protections do not necessarily include lewd, obscene, libelous or “fighting” words — “those which by their very utterances inflict injury or tend to incite an immediate breach of the peace.” [Read: Dunleavy investigates bureaucrat’s attack on gun-loving plumber] However, even that speech has strong protections. Rappers and hip hop artists have been threatened with with obscenity or outright censorship efforts, and rap lyrics made a name for themselves in the 2015 Supreme Court case Elonis v. United States, when the Court was asked to decide whether a song was a real threat because it contained lyrics that appeared to threaten the rap artist’s ex-wife. His conviction was overturned by the Supreme Court. But at the Alaska Commission on Human Rights, there is such a thing as hate speech, and Buscaglia is on the lookout for it, and has shown a willingness to use the authority of her office to punish people who she thinks is violating some kind of law. A law that doesn’t exist is being enforced. Buscaglia later told KTUU that her business card contained direct phone access to her and she had hoped to receive a call from the truck owner to learn more about the bumper sticker. “I wrote it on my business card expressly for the purpose that I expected the person to call me when they got it,” she said. “It has my direct line on there. The connotation that if you pull into the human commission parking lot and you see a truck with that sticker, you would wonder what’s going on.” That’s not what her note said. It said “Please do NOT park this truck with that offensive sticker in this parking lot.” Along with her business card was one from Kendall Rhyne, chief probation officer for the State of Alaska. Buscaglia claimed she was just trying to start a conversation with the truck owner. But was she? Or were those cards meant to add authority and intimidation to the handwritten note? In any case, she may not have started the conversation she wanted to have. Linegar, the truck owner, took the matter to his friends on Facebook, asking them if there’s something he didn’t understand about the Black Rifles Matter sticker. FIRST AMENDMENT PROTECTS POLITICAL SPEECH The purpose of the First Amendment is to protect the public from people like Marti Buscaglia, those who appoint themselves philosopher kings to sit on high and decree which political speech is protected and which must be removed from the public square — and from government-owned parking lots. As a person who had a career in newspapers, Buscaglia evidently never grasped the rule of law provided by the Constitution. She is now the agency chief in charge of enforcing — or abusing — its protections. And it’s taken a plumber to point out the problem with the situation. REPLY ERAK / MARCH 16, 2019 What is amazing is that the ED of Alaska’s HRC doesn’t understand the difference between elementary school civics and Social Justice dogma. But of course Democrats have had dominant control over education for the last 2 generations and hijacked it to the left. This is the result. What is most disturbing to me is the attempt to ruin the plumber’s business. That should be a punishable crime. What if it worked? REPLY JOURNAL THIS / MARCH 20, 2019 Not to mention she is a “journalist”, which we all know have been leaning hard left for a long time and don’t bother with facts. REPLY HUNTER / MARCH 21, 2019 She’s the furthest thing from being a journalist, she’s more of an activist and should not be working for the State of Alaska as head of the Human Rights Commision when she is in clear violation of protecting those rights. REPLY WAYNE WESTBERG / MARCH 16, 2019 In light of current state budgetary problems due to over government, this is a commission which should be eliminated, with all it’s expensive staff, entirely. What direct accomplishments do they have to support the need for and cost of their existence? REPLY ANN BROWN / MARCH 16, 2019 This is especially true as the duties of the Commission are largely redundant of the duties of the EEOC. The elimination of any duplicative State government service should be under serious consideration. If the Executive Director can concern herself with the minutiae of a random truck decal in her building’s parking lot, I would suggest that she and the Commission simply do not have enough real work to justify the Commission’s budget. REPLY AMBER HENRY / MARCH 17, 2019 Well said! And clearly she is not a gun owner! REPLY LARRY LINEGAR / MARCH 16, 2019 Great reporting as usual Suzanne. Sincerely appreciate the thoughtful reporting. REPLY TED / MARCH 16, 2019 Mr. Linegar, it’s a shame that you have to go through this process. If you seek redress for a state official attempting to circumvent your 1st amendment right, as well as tortuously interfering with your plumbing contract, please consider suing Marti Buscaglia individually, named as a defendant in your legal action. You could sue the State of Alaska for violation of your rights, but a suit against Ms. Buscaglia will get a lot if attention by everyone. Best of luck to you and sorry you got wronged by this idiot executive director. REPLY GARNET / MARCH 16, 2019 Ah alas… they always show their colors in the end, don’t they? She just can’t shut her mouth and her “excuses” are lame. Her scrambling is pathetic and sophomoric. Her best bet would have been to just say she was wrong. People can most always forgive that. Gun owner, no gun owner, black guns, black people…it matters not. What she did is a threat to everyone. Anyone with a bumper sticker, a screen-printed hoodie or t-shirt, etc. should be worried about people like this in positions of power – especially at the Human Rights Commission. The irony is such I had to re-read what I just typed! And then to further ask the building owner to ban the company? Good Lord lady, what were you thinking? The social justice warriors are so whipped up they can’t stop and think. I personally think a review should be conducted on every decision made and every case submitted to this agency under her tenure. If you can’t park in a public lot with a bumper sticker without her panties getting in a wad, what has happened to cases submitted that don’t fit her narrative? Did they end up in the shredder? Was something that may have leaned in favor of something that wasn’t “liberal” enough and fit her likes and desires compromised by her lack of “knowledge” or concern for the rights of ALL people? . The only answer is for her to go. Her time is up and her true colors exposed. The Governor has no choice now. Gov. Walker fired a H&SS employee for less (Rogue tweet about the President). DOC person I’m not sure. Haven’t heard his/her story yet. Was he/she complicit or did she just grab the business card for the “threat” factor? REPLY PHILLIP ELLIOTT / MARCH 16, 2019 Great article, probably the most comprehensive and “real” one I’ve read so far. I think the irony being left out of this entire fiasco is that the founder of Black Rifles Matter is a black man from Philadelphia who is a wonderful speaker and activist. How is it hate speech if the person who founded the group and profits from sales of merchandise like the sticker is in fact black? REPLY Suzanne Downing SUZANNE DOWNING (AUTHOR) / MARCH 16, 2019 Black Guns Matter is the group you are thinking of… same concept, just slightly different name. -sd REPLY MARLA / MARCH 16, 2019 At this point, it can’t be more clear: Marti Buscaglia is not fit to be the Executive Director of the Human Rights Commission for the State of Alaska. Her political proclivity and personal agenda is defined to include blind hatred and intolerance of another’s point of view and protected speech. She is also a despicable bully, using the resources of the government to address her position. She is beyond the bounds. It is interesting to note, as an aside, that her resume includes former publisher of the Fairbanks Daily Newsminer, the wacky Left-winger’s rag in Fairbanks. Dermot and Terrence Cole must he so very proud of Ms. Buscaglia, for trampling on the rights of others that they disagree with, then pounding it to death with their ever so boring writings. I hope the Governor fires this woman and sends a clear message to all, that the swamp is still being drained of slimy creatures who lurk in nasty cesspools, waiting to extinguish the rights of non-government workers. REPLY JAY / MARCH 16, 2019 What worries me is the fact that she even works for this administration. REPLY GARNET / MARCH 16, 2019 Amen Marla. Please Americans support our Governor as he weeds out this menace! REPLY STEVE STINE / MARCH 16, 2019 Ed, I agree with you on your quote from Khrushchev, as we see these same thoughts currently with Putin as president of Russia. Only today, the threat is more a “cyber” threat as more and more of U.S. technology contracts are now outsourced to foreign IT companies. NetCracker is a Moscow based company with an office outside of Boston that does work for the Pentagon as well as GCI. “Artificial intelligence is the future, not only for Russia, but for all humankind,” said Putin, reports RT. “It comes with colossal opportunities, but also threats that are difficult to predict. Whoever becomes the leader in this sphere will become the ruler of the world.” REPLY MONGO LIKE CANDY / MARCH 16, 2019 My best advice to her is to resign before she’s terminated and seek employment in Portland. REPLY MIKE COONS / MARCH 16, 2019 So Suzanne, what is her direct phone number that is on the card? I can’t make it out. REPLY MIKE COONS / MARCH 16, 2019 I called the commission and filed a complaint. Turns out recording gives her number as well. Thus a message left to her as well. Something that came to mind during those messages. Alaska has the strongest protection on privacy in our State Constitution of any State. She violated his right to privacy as well with the picture, my understanding, that included his License plate number as well. Black Rifles Matter has only to do with a description of a rifle. So that is not “racial” in any way. Now as to hate speech, Black Lives Matter organization calls for killing cops. That is HATE SPEECH and yes PROTECTED SPEECH! No matter how vial that is to me, SCOTUS has protected that vial speech. This will be an interesting week or so! REPLY EVAN BURCELL / MARCH 16, 2019 The most horrific thing about this is that this woman felt Justified in her actions. Which were by the definition of the laws she was meant to regulate a ‘hate crime’. She interpreted someone’s free speech based on her narrow bigoted mind set. Then based on her hatred, acted in a manner designed to hurt that person, both personally and professionally. This was made even more egregious in that she used the political office which she holds as a bolster for her actions. At the very least she should be prosecuted and due to her position in government be subject to the highest penalty offered under the laws she was meant to regulate. REPLY MQ / MARCH 16, 2019 How did Kendall Rhyne get involved? Did he just wander over and volunteer to leave his card? Did Marti ask him to participate? 2 high level state employees tell a private citizen to move his truck using their official business cards. Conspiracy, harassment. But then Marti goes on with the FB post, defaming his business and emails the building owner to use another contractor. Again, using her state position to harass the truck owner. The only hate speech here is Buscaglia trying to destroy the plumber’s business. REPLY SAM TUCK / MARCH 16, 2019 WOW! Nice try. My one simple question. Why is she still there? REPLY COLORADO/ALASKA CONSERVATIVE / MARCH 16, 2019 Is there a way to email Human Rights Commission Executive Director Buscaglia and the Commissioners? We do not do social media. The AK website only gives phone contact information for the Commissioners or “file a complaint.” We are new property owners to Alaska and we love that our friend who lives there full time connected us to Must Read Alaska. REPLY MIKE COONS / MARCH 16, 2019 I’d give them a call. They can ignore an e-mail, but you can really make your case by phone. More calls they get, better the outcome can or should be! REPLY GARNET / MARCH 16, 2019 Go to the State’s website and search for a state employee. http://alaska.gov/whitepages/. She is one (for now). Put in her name, and her email, etc will pop. Firstname.lastname alaska.gov REPLY DAMON / MARCH 16, 2019 Free Speech is under assault. Sadly, there are a lot more Buscaglias and Rhynes entrenched within Alaska state government. It seems like most of them work for state agencies that are not critical for our state to function. Yet these agencies are still draining our budget. Please take note, governor Dunleavy. REPLY JUST ME / MARCH 16, 2019 For those upset about the Governors actions to investigate, here is what Ms. Buscaglia said last year about how she handles complaints to her office: “First we get the inquiry. The investigator assesses whether there has been an act of discrimination under Alaska Statute 1880. If so, then they draft a complaint. Once the complainant signs that, then the respondent is served and asked to provide a position statement,” explained Commission Executive Director Marti Buscaglia. “Then it comes to me, as the head of the agency, to decide whether I’m going to send it through mediation or straight to the investigations process. We offer mediation on almost every case unless it’s a public policy issue or if it’s a very egregious complaint, for example, certain types of sexual harassment I wouldn’t send to mediation.” Are her actions egregious? Using your official position to threaten a persons livelihood and condemn his work? Yes, they are. She was willing to condemn a man, his workers, and his business without any due process. This abuse deserves a penalty equivalent to that she tried to wrongfully impose on an innocent person. In her position, she makes decisions that can ruin peoples lives. She has shown she lacks judgement. Remove her from her position, she has failed to uphold the higher level of behavior someone in her position should be required to have. Her history also demonstrates a willingness to offer lame excuses for her own blatant disregard of truth (lying on resume), yet a very judgmental viciousness in condemning those she disagrees with (hunters, gun rights advocates, etc). REPLY CHUCK / MARCH 16, 2019 Lets not forget her sidekick. This was probably not their first time to abuse their authority.Fire them both. REPLY STEVE / MARCH 16, 2019 Wow. The State of Alaska Thought Police. Many things come to mind, but right off the bat I wonder the cost of this commission to the State, and in times of tight budgets perhaps we don’t need fund the thought Police. The idea Ms. Buscaglia draws a state salary and rides that to a state retirement is really disturbing to me. Don’t we need officers of the Peace far more the “Thought Police” REPLY MIKE COONS / MARCH 17, 2019 Steve, well said. Question arises, it is a criminal offense both Federal and State to violate another’s civil liberties. Thus if a person has a complaint they can go to a lawyer and/or to the Federal government. I agree, the money spent on this office may very well pay for what another 8-10 State Troopers or maybe 5 or more DA’s? REPLY JACK WRIGHT / MARCH 16, 2019 And frankly, I wasn’t sure which one this was. Her job is not to know? And then commit restraint of trade because she wasn’t sure? You can be sure if it was a bumper sticker endorsing pro life she would not have been offended. Is there room in her job for personal bias? Wasn’t some one just questioned about her personal beliefs during her job interview. Didn’t we just read a story about that? Is this commissioner going to sue the plumber for libel also? REPLY TOPSY TURVY / MARCH 20, 2019 She may very well find offense in any and everything, especially pro life if she is pro choice. REPLY MORRIGAN / MARCH 16, 2019 If Commissar Buscaglia acted under color of law, Brenton the Plumber might be looking at a generous, early retirement. . Title 18, U.S.C., Section 242: “Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States,…shall be fined under this title or imprisoned not more than one year, or both…” . Ninth Circuit Court noted in “United States v. Classic, 313 U.S. 299, 326 (1941)”: “Misuse of power, possessed by virtue of state law and possible only because the wrongdoer is clothed with the authority of state law, is action taken under color of state law.” . Abuse of power, conferred by state law, is an action under color of law. [West v. Atkins, 487 U.S. 42, 49-50 (1988)]. . Then there’s Anderson v. Warner, 9th Circuit, June 26, 2006, No. 04-15505; 2006 DJDAR 8188; the Ninth Court held three requirements for acting under color of law: (1) acting or pretending to act in the performance of official duties; (2) acts were intended to, and did, influence behavior of others; (3) conduct must be meaningfully-related in some way to official duties. . Good luck, Brenton the Plumber! REPLY COXEN / MARCH 17, 2019 My understanding is that if two or more people “conspire” that it is a federal felony that is in it self another violation. ? REPLY STEVE-O / MARCH 16, 2019 Buscaglia said “I wrote it on my business card expressly for the purpose that I expected the person to call me when they got it,” if that was her express purpose then why didn’t she write call me at the number on the front of this, my government supplied business card? Instead she wrote “Please do NOT park this truck with that offensive sticker in this parking lot.” Then she went and posted her opinion on a government website on a government supplied computer, and tried to get the plumber fired. I’m guessing that when she wrote “In what world is this OK?” she never thought about the irony that what she was doing is not OK in this world. REPLY LEE TERRY / MARCH 18, 2019 Well said. Leftists usually fail to see the irony in their thoughts and deeds. If they do succeed on “seeing” them in their own mind, they ignore those thoughts and justify their actions in the name of “social justice”. REPLY DENNIS JACKSON / MARCH 17, 2019 “Whoever, under color of any law, statute, ordinance, regulation or custom willfully subjects any person, in any state, territory, commonwealth, possession or District to the deprivation of any rights, privileges or immunities secured or protected by the Constitution or Laws of the United States… May be imprisoned and fined, or both, under this title… 18 United States Code Section 242 This is a Federal Felony, maybe someone needs to tell those who left their cards in an attempt to intimidate a citizen in the pursuance of their First and Second Amendment Rights. Of course if both were actually there and participated together then it is a conspiracy and that is covered under Sectio 241 of the same title except now it’s 10 years and a $10,000.00 fine or both. Yep, we need more government to pay more ignorant people to harass we citizens. Socialism at its finest moment folks. This is straight up Marxist ideology to denegrate people in pursuance of their rights to implement behavior modification and control. See “cognitive behavior modification” for details on how this is accomplished. Or did you think all these moves were simply coincidence? The same commissions of other states were the ones filing suits against the baker and florist. The baker won and they set him up again after the Surpreme Court upheld his position. That is the measure of these critter’s resolve. They are out to persecute you for how you think, act or believe and they will use any reason to achieve their goals. REPLY JMARK / MARCH 17, 2019 I just spent some time reading the statutes, AS 18.80, setting forth the jurisdiction and responsibilities of the Equal Rights Commission. I do not see ANY provision that authorizes Ms. Buscalgia to engage, within the scope of her employment, in the acts described here. In particular, the statutes in no way permit her or her agency to “police” free expression. This is a fairly straight-forward case. Ms Buscalgia should be terminated for misuse of her position, incompetence and perhaps criminal activity. And we haven’t yet seen if she has misrepresented her qualifications. There are many Alaskans with college and graduate degrees and the necessary intelligence that would welcome the privilege of serving Alaskans within the bounds of the law. REPLY TODD OR CHERYL HANSON / MARCH 18, 2019 Ms. Buscalgia and Kendall Rhyne need to be terminated ASAP due to their abuse of power. REPLY I CALL BS / MARCH 20, 2019 If Buscaglia knew enough about the owner of the truck to slam their business to their client, she knew enough about how to contact them directly without abusing her office. Stupid Liberal Marti is a liar.
The connotation that if you pull into the human commission parking lot and you see a truck with that sticker, you would wonder what’s going on.”
That’s not what her note said. It said “Please do NOT park this truck with that offensive sticker in this parking lot.”
Along with her business card was one from Kendall Rhyne, chief probation officer for the State of Alaska.

Art, what have you heard about the parole officer and his business card in the news? I haven't seen anything that has placed the man there at the scene. Did I miss it?

It has been long enough now with no new information that it has probably been swept under the rug. I wouldn't go that far as a meeting has been set to bring this thing to a conclusion and i'd have to say it's not looking to good for the snowflake Buscaglia. The Alaska Human Rights Commission has an executive session meeting scheduled for Monday, April 1 to take up the matter of its top manager: Can Marti Buscaglia be salvaged or has she so damaged the reputation of the commission that she must be shown the door?

That's ok, I'll ass shoot a dink.

Tried to find a news story with comments supporting Marti. None found. I bet she is fired on Monday. It should be with cause and unemployment should not be paid.

I know where I stand and how I feel about some left-wing bitch that commissions herself as the arbiter of everyone else’s speech. What I don’t know, unless I missed it, is what she looks like. 😁
I hate drawing conclusions only to find out that my conclusion was right but the bitch was cute, I doubt that’s the case here but I’m doing my due diligence first. 😂
Either way I hope they fire her and her cohort, if she’s cute then I hope she gets objectified in a publicly offensive way before she gets fired. I truly hate useless government employees that feel empowered because of the header on their paycheck and god knows there’s no shortage of them.

Rumor has it a few "decisions" by the perp have been swept and she is being reviewed for more than a single incident. CA SJW moves to AK for that position... What could go wrong?

Yeah, the board is a bunch of serial leftists, as one would expect of such a board, but it is hard to imagine having enough balls to let that slide.
I hope the victim files a suit just to help it sink into the idiots on the board that she is not the right person for the position and will cost them more.
I also want to know what happened to the PO that left his card with hers..

Yep. I'd throw a few dollars in support of that on behalf of the contractor. As for the PO, he managed to keep his profile in the shade of the whole deal. Trying to get the contractor fired was the biggest deal and was not (apparently?) covered by the board.

Gov needs to drop kick the board, victim needs to file a suit against Marti, and possibly the state. I can hear lawyers drooling already - not even a drip, drip ---- more like the sound of pissing.

That's a darn shame they're keeping this woman employed. It takes a bigger, stronger person to find common ground with fellow Americans, than inflame hostilities over subtle differences of opinion. She took that typical approach of inflaming social media/burn someone at the stake, rather than a process. That woman either needs to get laid, or maybe do some real work, like grow a garden, or put away a few cords of firewood. Or both? I would suggest that this drama-laiden woman also have a visit with this guy, he's got real nerves of steel working the real streets of unifying America: https://www.npr.org/2017/08/20/5448...klux-klan-members-to-give-up-their-robesIf she took the Daryl Davis approach, she maybe would've learned that the guy with the bumper sticker, is a plumber. Plumbers are hard workers, and know how to lay the pipe. She probably could've gotten lucky, rather than chumming with the skill-less, labor-less office loosers.

If I was ol boy I would lawyer and sue the living chit out the human rights commission. Another commission in another state got their pee pees slapped by the supreme court. You all might remember this one. https://en.wikipedia.org/wiki/Masterpiece_Cakeshop_v._Colorado_Civil_Rights_Commission
Then STFU. The rest of your statement is superflous bullshit with no real bearing on this discussion other than to massage your own ego. Suckin' on my titties like you wanted me.

The fact that she threatened to have the owner of the building hire some one else to do the work in the building has been swept under the rug by everyone!!!!!! That has been mentioned repeatedly... Not that I have seen in ADN or KTUU.other when this first started once!!! Just another thing being swept away so John Q Public will forget about it in a couple of months.

Looking at the "body of work" posted on their home page it is obvious the commission deals with very small potatoes in a bunch of very marginal situations and it costs a lot for very little in the way of positive output for Alaskans.

BLACK RIFLES MATTER Must Read Alaska has learned that Marti Buscaglia, the embattled executive director of the Alaska Human Rights Commission, has resigned, effective April 26. Buscaglia resigned in a memo sent to the chairman of the board of the commission, Brandon Nakasato, and the other commissioners. It is dated April 8.

Buscaglia was born in Peru, raised in California, and is currently Alaska's bitch. True, and no offense intended to the good folks of MN, such as yourself. If memory serves me, she was a newspaper publisher in MN just prior to coming up here. Still a gun-hating, liberal, bitch, IMO.

Now the state needs to disband the whole organization. Exactly, they voted 5-2 to let her remain as commisioner, those 5 need to be let go pronto. The primary work of that Commission seems to involve forcing employers to keep marginal employees in dysfunctional offices. No one with enough sense to get and hold a decent job would ever need them. They are nothing but a serious drain...

https://mustreadalaska.com/thats-three-out-chairman-of-human-rights-commission-also-quits/And two more go away... the Chairman and vice-chairman of the Board (both voting for her retention) have quit. That’s three out: Chairman of Human Rights Commission also quits The chairman of the Alaska Human Rights Commission has resigned, Must Read Alaska has learned. Brandon Nakasato’s resignation comes on the heels of the resignation of the vice chair, Freddie R. Olin IV, and after the resignation of the agency’s executive director Marti Buscaglia. Five of the seven commissioners voted to retain Buscaglia after she abused the constitutional rights of an Alaskan who had parked his truck in the parking lot of the Human Rights Commission on A Street in Anchorage. His truck decal said “Black Rifles Matter,” and Buscaglia used her business card to write a note to the owner telling him to get his offensive sticker out of the parking lot. It is a Second Amendment decal and she thought it might be hate speech. [Read: Human Rights Commission director resigns] [Read: Black Rifles Matter: House members call for commissioners to resign] After an investigation was conducted and a report submitted to the commission, many expected Buscaglia to be fired, but the majority of the members, who are volunteers, said she should just receive a 15-day suspension and provide an apology to the public. She resigned the next business day. Two of the five commissioners who voted to retain her have now resigned. The chair, Nakasato, is a research analyst with the Department of Health and Social Services. The governor now must replace two commissioners, which will likely change the Human Rights Commission governing body to a more constitutionally sensitive majority who will be in charge of hiring the next executive director.

Gov should not "replace" any of these people. Promote from within the ranks (without then filling THAT position anew) if anyone is qualified and reduce the number of parasites doing virtually nothing for big bucks. Reduce bureaucracy by attrition, if he cannot eliminate paid positions any other way.
Oops- I see commissars are volunteers. Without expense accounts, I hope.

Bob, In this case the gal in question did not work for the Governor. She worked for the Commission. They were the ones with the authority to retain or dismiss. There is no doubtin my mind that our gov. had just a peach more of a part in her resignation than we will ever know. Ok by me certainly... bhtr

Congrats, none the less for Alaskans this is a BIG win. The fact that you also had 2 commission board members who were in favor of her staying resigning makes it even sweeter. Now put the pressure on the remaining Commission members to ask for Kendall Ryhnes resignation also, as you all recall he lent his influence against the plumber too. As second in command he has also shown his in ability to perform in an acceptable manner. High level left wing liberal swamp dwelling bureaucrats done away by a plumber. This is great, an ordinary works with his hands man takes out upper level asshats. Push this Rhynes turd out too. A man than fixes toilets as well as other plumbing functions shows us how to flush lightweight turds down the toilet and away. The left, for so long has pushed and shoved to get their way on every aspect in our lives to the way they want it, defeated. They took off their gloves along time a go to engage in dirty politics while the right has stood there wringing their hands saying oh we can't do this or that it wouldn't be fair. The thing is there is no working with the left, you give a half inch and they take a mile. They have 90+% of the media spewing their dogma propaganda. A lot of moderates in this country still can't admit to the fact that the left(democrats) would stoop as low as they have to achieve their ends. This has been a very large contributing factor to the lefts success. DJT said we need to drain the swamp, he can't do it by himself, he needs to have more plumbers to help him ,he needs all of us to speak up and object to liberal crap put out by people like Marti Buscaglia. Flood the commissions with e-mails, the governors office ,your represenatives and senators. Keep talking up the policies and injustice of bureaucrats every time they wrongly use their office for political means. On November 8th of 2016 the angry white males and their women swept the trash out of the Whitehouse and made sure more didn't re-enter it. It is our turn again to help DJT drain the swamp of these same people in our gov't, he can't do it all by himself. It is time to play the game as dirty as the left does.

See if your pea brain can grasp that she left on her own terms not fired. Maybe find someone and have them explain the difference between quitting/retiring and getting fired. Ask this person that’s explaining it to you what the difference is. I guess accountability doesn’t mean anything to your kind. A win would have been the whole department going away. A [bleep] second place would have been the committee firing her. This is nothing.

Another one bites the dust. ‘BLACK RIFLES’ MATTER FALLOUT CONTINUES Sarah Monkton, the acting executive director of the Alaska Human Rights Commission has resigned, Must Read Alaska has learned. Earlier this month, two volunteer members of the commission resigned after the agency became embroiled in a national controversy stemming from abuses by its previous executive director, who has also resigned. Monkton was serving as the acting chief of the beleaguered agency. More: http://mustreadalaska.com/breaking-acting-director-of-human-rights-commission-resigns/

Not worth the effort for a pathetic idiot not interested in adding anything of value anywhere. Way to much “value” being added by the most important man in the state that has everything figured out. If they would just listen to you. Now you at least understand something correctly. Coming in like you did, a bar bully, with absolutely nothing of value to add and telling yourself you are special is not a productive path. Good luck. If anyone gave half a [bleep] about what you value maybe your statements might mean something. That won’t ever happen. Funny you drunk drooling dumbfucks mention bar bullies. Must have some real mental, physical and emotional, scars from some beatings. I don’t need luck, Jerk Off. Show us on the doll where you were touched?
Then STFU. The rest of your statement is superflous bullshit with no real bearing on this discussion other than to massage your own ego. Suckin' on my titties like you wanted me.

And the screw continues to turn... Why this agency is even needed is very questionable. But "let's expend their authority" seems the worst possible idea. https://mustreadalaska.com/turning-a-corner-human-rights-commission-elects-new-chair-vice-chair/Turning a corner, Human Rights Commission elects new chair, vice chair Megan C. Mackiernan is the new chair for the Alaska Commission on Human Rights, replacing Brandon Nakasato. Marcus Sanders, pictured above, has been elected vice chair and will help lead the hiring of a new executive director. The previous chair and vice chair resigned after a scandal enveloped both the staff and governing commission. It involved a “Black Rifles Matter” decal on a truck parked in the agency’s parking lot and former Executive Director Marti Buscaglia’s inappropriate actions in response to that decal. Upheaval at the agency occurred after Buscaglia ordered a workman to remove his truck and its “Black Rifles Matter” sticker from the agency’s parking lot. This was seen by many Alaskans to be an abuse of power. The state investigated the matter and handed its findings to the commissioners of the agency, but they chose to retain the executive director. Her punishment was a 15-day suspension and she was required to apologize to the workman. Instead, Buscaglia resigned. Must Read Alaska has learned that former Executive Director Buscaglia has not apologized to the workman for misusing her position and mocking him on Facebook on the agency’s official page. Such an apology is not likely to be forthcoming because it was a condition of her employment, which she terminated voluntarily. The acting director of the agency, Sarah Monkton, has also since resigned. The commission members now consist of three choices of Gov. Michael Dunleavy: Marcus Sanders, Anchorage; Cynthia Erickson, Tanana; and Debbie Fullenwider, Anchorage. The other four board members are David A. Barton, Anchorage; Christa J. Bruce, Ketchikan; Kathryn E. Dodge, Fairbanks; and Megan C. Mackiernan, Nome. As a part of the agency’s 2019-2023 strategic plan, the commission intended to work with the Alaska Legislature to add non-profits to its jurisdiction, which would give it authority over 44,000 additional workers in everything from dog shelters to faith-based organizations.
