I am not particularly a fan of Johnstone... we have him to thank for the felt sole ban... but he is at least on the side of putting salmon in the rivers again. Medred wrongly states there have not been any studies on Sports Fish Value to the State and local areas, but there have been many, just not done BY the State.

Yet again Alaska appears to be gearing up for a big fight focused on one of the state’s smallest commercial fisheries.

The United Fishermen of Alaska, one of the most politically powerful organizations in the north, over the weekend posted an “Action Alert” calling on its members to oppose the appointment of Karl Johnstone based on his actions when he served the BOF (Board of Fisheries) from 2008-2015.”

Appointed to the Board again on the first of the month by Gov. Mike Dunleavy, Johnstone this weeks starts confirmation hearings before the Alaska Legislature.

A retired Alaska Superior Court judge, Johnstone was generally well-respected by the majority of commercial, personal-use, subsistence and sport fishermen across the breadth of the state when he earlier served on the Board, but he stirred emotions in Cook Inlet.

The Inlet supports a comparatively small commercial fishery over which Alaskans fight a lot.

The Alaska Department of Fish and Game is projecting a 2019, statewide, commercial harvest of 213.2 million salmon. About 7.2 million of those fish, or about 3 percent of the total harvest, is expected to come from the Inlet.

And the Upper Inlet – where the real battle is focused on harvests of red (sockeye), silver (coho), and king (Chinook) salmon – is forecast to have a commercial catch of about 3.5 million or less than 2 percent of the statewide harvest.

But the Inlet is where the UFA – now led by Matt Alward, a commercial net maker from the community of Homer at the foot of the Inlet – appears to have drawn the line on Johnstone.

Fish wars
The stage for the National Geographic television show “Alaska Fish Wars,” the Inlet is a 220-mile-long finger of the Gulf of Alaska stabbing into the urban underbelly of the state. Lapping first at the doorstep of Anchorage, it washes north to the edge of the Matanuska-Susitna Borough.

Together the two areas comprise the Anchorage metro area home to more than half the state’s population. A large number of them are non-commercial fishermen of some sort, and they are regularly in disagreement with the fewer than 1,300 commercial fishermen holding 569 commercial drift gillnet permits and 734 set gillnet permits that allow them to catch and sell millions of Inlet salmon.

Depending almost entirely on the size of sockeye salmon returns in the Inlet, the commercial fishermen take anywhere from 75 percent to 90 percent of the returning salmon. Last year was an abysmal season for commercial fishermen, and they harvested only 1.3 million – a mere 39 percent of the 10-year average.

Non-commercial, personal-use dipnetters caught about 390,000, 74 percent of the previous year but less than 50 percent of the peak harvests of mid-decade. Anglers are estimated to have bagged less than 500,000, but accurate numbers on that catch aren’t yet available.

In his last term on the Board, Johnstone ran afoul of the United Cook Inlet Drifters Association (UCIDA), the most powerful of the region’s fishing groups, when the Board refused to interview commercial fisherman, commercial-fishermen favorite, and one-time UCIDA executive director Roland Maw for the job of Commissioner of the Alaska Department of Fish and Game.

Johnstone was at the time the chairman of the Board. His chairmanship ended shortly thereafter.

“The Board of Fisheries made a mockery of a public process and the law when it refused, without comment, to interview (Maw)…,” the Alaska Journal of Commerce charged after Maw was told to go fish. “(And) when Johnstone resigned, (then-Gov. Bill) Walker tapped Maw to replace him. The move is stunning, and not just for the Hollywood plot twist. Maw is a far stronger commercial fishing advocate than any of the other members of the Board who come from the industry, and replacing Johnstone with Maw reverses the balance of power on the seven-member board. The sport fish majority led by Johnstone instituted radical changes to Cook Inlet fisheries at its 2011 and 2014 meetings. After the 2011 meeting, Johnstone said that the allocative decisions made in some cases were worth ‘millions of dollars.”

Maw didn’t last long. He resigned when it was discovered he was claiming to be a resident of Montana as well of Alaska. He is still awaiting trial on charges of stealing Alaska Permanent Fund Dividends (PFDs) to which Montana residents are not entitled.

Despite Maws resignation, the Board’s reorientation toward putting more salmon in the nets of commercial fishermen in the Inlet remained. UCIDA is worried, one of the stars of the former “Fish Wars” show argues, that Johnstone could help shift the Board’s emphasis toward putting more fish in Inlet creeks and rivers.

Economics
Commercial fishermen believe that letting large numbers of salmon escape to spawn instead of getting caught in nets leads to “overescapement” which leads to fewer fish in the future. The scientific evidence for that idea, except at massive levels of escapements, is weak.

“Although overescapement was easy to detect, the biological and fishery-related effects of overescapement were more difficult to detect and assess,” a state study concluded. Yield in some cases fell, the study said, but “we did not observe long-term stock collapse of any of the 40 stocks (studied) that could be attributed to overescapement.”

Canadian scientists even more bluntly rejected the idea, stating that though they found “evidence of a decrease in spawning efficiency at high spawning numbers, there is no evidence for anything like a ‘collapse’ or ‘near-collapse’ of production following runs with very large numbers of spawners.”

And the Wild Salmon Center warned against “the concept of ‘overescapement’ being used as a justification for increased commercial harvest of salmon.”

Past decisions to put more fish in freshwater when Johnstone was on the Board did work largely in favor of anglers who help support large and what were steadily growing sport fisheries in both the Mat-Su and on the Kenai Peninsula.

Good freshwater fishing for salmon was in turn good for tourism businesses, and Johnstone has been something of an advocate for maximum yield management of state fisheries on both the salmon conservation and economic fronts.

In an evolving global economy, University of Alaska Fairbanks Keith Criddle observed in a 2014 study on the Economic Importance of Wild Salmon, “the marginal net economic benefits of sport harvests can be substantial and may exceed the marginal net economic benefits of commercial catches.”

Assessing value is, however, difficult because, as Criddle went on to note, “there are no region-wide estimates of these (sport fish) values.”

Fish and Game annually reports the value of commercial harvests, but makes little attempt to calculate the same for sport, personal-use and subsistence fisheries. Commercial fishermen have opposed economic studies of sportfish values since a 1987 a study concluded anglers in 1986 spent more than $127 million ($288 million in 2019 dollars) on sport fishing in the region, primarily in streams around Cook Inlet.

Sport fishing has grown significantly since 1987. Both Bass Pro and Cabelas, the country’s two biggest outdoor retail chains, opened stores in Anchorage as the outdoor sports boomed.

The Cook Inlet harvest was last year valued at $11 million, but it was a bad year. The 10-year average is $31 million. But salmon prices have largely flatlined in recent years.

“Because farmed Atlantic and Pacific salmon compete with wild Pacific salmon in global markets, the economic value of wild Pacific salmon and the economic value of farmed salmon are jointly determined,” Criddle concluded.

“Over the past three decades, consumers have been willing to purchase ever-increasing quantities of salmon, but only at lower prices. At the same time, technological innovation in salmon farming has allowed unit production costs to fall fast enough to keep pace with market clearing prices, and it has been profitable to increase total farmed production. This has been unambiguously bad news for the producers of wild salmon….

“Barring radical changes in the organization of wild salmon fisheries, the long run prospects are for declining net revenues to commercial fishermen and their communities.”

Commercial fisheries in Alaska have been saved from some of the consequences of this shift by unprecedented salmon returns to since the 1980s when the annual commercial harvest topped 100 million for the first time in decades. It continued to grow over the years that followed thanks to a warmer North Pacific Ocean.

Since the shift began, Alaska salmon have been an estimated three times more productive than in the 1946-75 period, according to the National Oceanic and Atmospheric Administration (NOAA). During the five years “The Blob” was cooking the North Pacific, Alaska commercial harvests averaged close to 205 million fish per year.

Fisheries scientists have long been skeptical such high harvests can be maintained, expecting them to shrink again either because of a return of a colder phase in the Pacific or global-warming rendering the waters too warm for maximum salmon productivity.

But to date Alaska has, overall, enjoyed decades of the good-new days despite some regional blips as in the Inlet last year, and yet they fight over fish as much as ever.

I’ve long thought that the “inshore” fisheries close to population centers that are most popular and accessible to sport fishers should be reserved for sport fishing. They bring FAR more dollars into the local economic food chain and those dollars are spread out through the local communities from gas stations to hotels, airlines, tackleshops, grocery stores, restaurants etc. Areas accessible to sport fishermen are limited, whereas virtually everywhere is accessible to the commercial guys. Gill nets are also a schitty ass way to fish in mixed stock fisheries where escapement is a driving factor. “Over-escapement” causes collapse? LMFAO....more fish to gravel means less fish? What mutherfuckingidiot took that horseshit and thought it’d stick? Overfishing and bycatch by commercial fishing certainly does but proffering the lunacy that killing as many fish before they can spawn results in more fish sounds like something a red faced, powdered nose commercial fisherman would be hollering from a barstool as he blows a seasons worth of earnings after a booze and coke filled weekend at the bar. Unfortunately for sport fishers they’re not as “organized” as the commercial “union racketeers” and don’t buy nearly as many politicians as the commercial guys can. 😉

That Maw guy sounds like the perfect face for Cook Inlet gillnetters....hopefully he’ll check out some 3rd grade level science books from the prison library. Fugging scumbag.

My opinion is that since charter boats are bound by sport fishing regulations they are NOT commercial fishing.

The Exxon Valdez was one of the worst things that ever happened to commercial salmon fishermen. They could not fish vast areas of Alaska for one season... and not a great season, either. But the rivers were so flooded with fish it was incredible! Adding to the dilemma of people actually seeing what a serious run looks like was their "over-escapement" mantra. Doubling down on stupid they kept talking about how horrible each run parented by that season (1989) would be. Every run in every area came back in incredible size with monster fish (of the fish that stay in freshwater after hatching) for two generations.

At Statehood fish traps were outlawed. They are probably the best answer for managing a mixed stock river like the Kenai, which is the primary Cook Inlet fishery. It would allow ALL kings to be returned to the river and reds to be kept in a smooth distribution across the run times. It would solve a lot of problems in the same way many other fisheries have done so across Alaska.

SitkaDeer, I agree. Fish traps are worlds better in mixed stock or selective fisheries than gill nets, they’ve been strongly opposed down here by......guess who?......if you guessed the non-tribal commercial fisherman’s racketeering association you’d have guessed correctly.

Anything to prevent “over escapement”.

Regarding the Exxon Valdez.....I remember the wailing and grinding of teeth from the commercial guys. A lot of those same guys made more money that year than they ever made, even in their best season and they never even fished. 😉. They took the government payouts and hired their vessel out to help the cleanup, neither of which I have an issue with considering the circumstances.

Over escapement....lmfao. 😂.....we can only dream of putting too many fish in the rivers to make more fish. I’m sure it’d be detrimental to every other living organism in the ecosystem that relies on those fish. Bears so fat they can’t fit into their den, extra nutrients in the rivers, trout that are so gorged on fish eggs that they’ve sworn off red meat and became vegetarians and so many other catastrophic consequences too numerous to list. 😉

Charter boats are in limbo. They claim we are commercial but want us to play by sport rules with sport allocations. Charters have quietly been getting very organized and funded though. Comm fish is used to getting its way but those days are coming to an end.

The charter industry is booming though. Here in SE permits keep climbing and climbing. Made an offer on another permit and it was gone with a full price offer in a few days at a record price.

Can anyone please explain that to me in a way that my 9th grade science teacher would have accepted?
His reaction would have been to shred them for their lack of established scientific process in making their theory.

I would like to see the commercial claim get a court hearing. Actually it probably has... It just seems wrong on the surface, and worse the deeper you go. I go with "glorified water taxi."

There are too many variables with unknown effects. One buzzword that hung around for awhile was "spawning efficiency" but that question answers itself and several other questions. So the increase in spawning salmon means the returns are not as high per spawning fish. So what? There goes your "over-recruitment" claim.

Science really isn't science in their view unless you know the answer before you start... and it backs their needs.

Someone is trying to throw sheit at the wall with the over-escapement. ODFW uses the term escapement as a good thing when speaking of setting hunting season dates, duration, and restrictions.
Tells me all I need to know.

There is so much going on below and above the water in these cases and the managers have done shut a horrible job of maintaining fish stocks that it certainly looks like it should be someone else's turn to give it a try.

Agreed! There’s so much wrong that finding a place to start would be daunting. I’d start with the by-catch and require that salmon, halibut, cod, etc be kept and processed onboard the trawlers so as to be marketable. The bycatch from large trawlers is incredible and dumping dead salmon or halibut over the side because it’s not the targeted species makes no sense to me and is counterintuitive to conservation. If they were made to keep it and process the fish properly they might lose storage in their fish holds and they might not be able to make as many McFish sandwiches or meet their corporate mandated numbers but they would NOT be allowed to sell it, instead it could offset the IFQ’s of those on the “list” for the corresponding species. After a certain number or tonnage of bycatch is met then that vessel is done fishing and returns to port to give their bycatch to the smaller IFQ owners. Some of those smaller operators might never need to leave port all season but still make money as if their season was great. The trawler might be targeting pollock for the McFish sandwich but if they haul in a load of say King salmon then they would be required to care for those fish FIRST so they bring fair market value to someone holding that IFQ. Any discrepancy in quality and lower than market price would be the responsibility of the company to make up the difference to the IFQ holders. It would essentially “buy down” the amount of fish left to catch. Observers on every boat with a minimum of 2 and going up from there depending upon the size of the vessel paid for by the trawler but NOT employed by the trawler. Massive fines for the law breakers, so massive that it’s a major disincentive to fug up. Those fines should be reinvested into real fisheries management and/or to buy out the yearly IFQ of individual owner operators of smaller vessels, it would not go to the state or feds! Because of the offset between by-catch and IFQ holders those boats that don’t need to fish because it was done for them means less/no fuel costs and less carbon emissions from the vessels that stay in port. 😉

The by-catch could also be used to support subsistence fishermen during times of depleted returns. I’d also like to see less exportation of our resources to Asia with a cap on the exportation of fish and raw wood products. Agreed! There’s so much wrong that finding a place to start would be daunting. Any discrepancy in quality and lower than market price would be the responsibility of the company to make up the difference to the IFQ holders. It would essentially “buy down” the amount of fish left to catch. Observers on every boat with a minimum of 2 and going up from there depending upon the size of the vessel paid for by the trawler but NOT employed by the trawler. Massive fines for the law breakers, so massive that it’s a major disincentive to fug up. Those fines should be reinvested into real fisheries management and/or to buy out the yearly IFQ of individual owner operators of smaller vessels, it would not go to the state or feds! Because of the offset between by-catch and IFQ holders those boats that don’t need to fish because it was done for them means less/no fuel costs and less carbon emissions from the vessels that stay in port. 😉

The by-catch could also be used to support subsistence fishermen during times of depleted returns. I’d also like to see less exportation of our resources to Asia with a cap on the exportation of fish and raw wood products. Sitka, I don’t take your criticism as an insult because I know that my knowledge of your (Alaska) system of fisheries management is deficient and the system is complex. I was merely spitballing some thoughts, brainstorming if you will. The observer system might be a joke (I’ve heard that from a lot of different guys) but it doesn’t mean that it couldn’t work if it was restructured. There’s so many moving parts that like I said earlier, it’s daunting. I certainly don’t have the answers but I do know that the way it’s structured now in its totality is a joke. Nobody likes change but change is what’s needed for the long term health of the resource.

I do think that transparency has always been lacking because as you said, it would reveal a far larger scope than is currently accepted. That’s science for ya.....ignore the reality and pretend everything is fine. When it’s realized that it’s not fine blame the sport fishers, increase license fees, shorten seasons and limits and claim a win. 🙄

PWS state hatcheries put out a third of the entire state? I find that hard to accept.

King salmon are in short supply and they count them by the hundreds. Humpies are way above any historical number and they want to pump out more cheap fish...

Only one hatchery in SE produces pinks.

Hatcheries don't produce kings because they lose money on them, it costs too much to raise them vs what they make back when they return. Unfortunately no hatchery will produce just coho/kings without some outside support from a hatchery that produces pinks/chums or government funding (Little Port Walter).

There is a guy that keeps trying to start a king hatchery at Baranof warm springs, he wants to do something like 100 million kings. Keeps getting rejected and gets a lot of opposition from locals because "they don't want to look at a hatchery". It is a good spot for a hatchery and it could be successful.

Port Armstrong is doing something groundbreaking with their coho production. They send half their production to saltwater before the fish smolt, at around 5 grams. The limiting factor for raising coho is freshwater rearing space. If they return well, it could mean that hatcheries could ramp up their coho production without changing their freshwater rearing space. This will be the first year for a return from about a 2.5 million smolt release of these fish so it will be interesting to see how they return.

When returns inevitably started to fall off they built a cannery but located it on the lagoon which is tidal. The smolt were released straight into the lagoon as they did not understand why a lake was necessary for reds. When I was there 80+ years later there were a few red salmon that returned to the lagoon every year and successfully spawned in the brackish lagoon right in front of the long gone hatchery. I spoke with fish and game when they were beach seining some sockeye there to sample. They said that they would use the fish for brood stock if there was a low enough incidence of some virus that sockeye carry naturally. Speaking to the guys the following year they said there was too much of the virus to use these unique intertidally spawning fish for stocking other rivers.

That virus is IHN. Coho and kings are susceptible to BKD, and it can be a real problem.

Kangaroo court: Committee tries to sink Fish Board nominee

The retired Alaska Superior Court judge was no doubt ready for the barrage of heavy fire he took in the combined House Fisheries/Natural Resources Committee meeting on Monday night.

Karl Johnstone knew coming into his interview that the commercial fishing interests were loaded for bear in opposition of his nomination to the Fisheries Board, a volunteer position. And the committee was stacked with opponents of Gov. Michael Dunleavy who had had targeted him.

And yet Johnstone was courteous, open, and answered the committee’s accusatory questions fully, without rancor.

If they were hoping to wear him down by “Kavanaughing” him, it didn’t work.


KARL JOHNSTONE

Rep. Louise Stutes chaired the meeting. She had already, in written communications to her commercial fishing friends, declared all-out war on Johnstone’s nomination, saying she would do everything in her power to prevent him from being confirmed.

Stutes went so far as to read an anonymous letter into the record, opposing Johnstone. No one on the joint committee objected to her doing so, and she ruled the committee with an iron hand. She made exaggerated expressions during the meeting that Johnstone could not see, but which expressed disapproval or disbelief.

As a committee aide provided material to the attack team on the committee, they asked Johnstone questions they were given to ask. Some of the questions ended up embarrassing the committee members who asked them.

Rep. Sara Hannan wanted to know if Johnstone is a snowbird and how many days he spends in the state. Enough to qualify for a Permanent Fund dividend, Johnstone said. Hannan was trying to imply that having a second home out of state or traveling widely as a retiree should be a disqualifier.

Hannan asked if he took cost of living allowances in his retirement, and she expressed surprise to learn that COLA doesn’t apply to the retirement pensions of retired judges. Stutes’ staff had set her up to look unprepared.

Hannan wanted to know why in 2009 he stayed at the Captain Cook Hotel during the Fish Board meetings. He answered he stayed there because he was advised to stay there by Fish and Game. He was told it would be best if he was on site early and stayed late into the evening to interact with attendees.

Hannan wanted to know how much he had donated to the Dunleavy campaign. Johnstone had been an early supporter of the campaign of Charlie Huggins before Huggins dropped from the race, and then Johnstone supported Dunleavy. But he said none of that. To the committee he only said yes, he supported Dunleavy and donated to the political action committee that supported the candidacy of the governor who has since appointed him, and it was $1,000.

Hannan expressed to the committee that she felt that was a problem.

Rep. Geran Tarr implied, delicately, that Johnstone is too old to serve on the Board, and should spend more time “transitioning” and visiting his family. Tarr pondered aloud that he may have too much experience, since he has, in the past, served three terms on the Board of Fisheries. She said maybe it’s time for someone else to serve.

Tarr, who is often heard championing food security with Alaskans, then took up the cause of out-of-state commercial permit holders, rather than those rod-and-reel and dip netters from her own lower-income East Anchorage neighborhoods, who are trying to supplement their food budgets with fish from the rivers.

She said she was troubled that he seemed more concerned with personal use fishing than commercial fishing and that he was not acknowledging climate change as a factor in the changing fishing conditions in Alaska.

Rep. Ivy Spohnholz wanted to know why, when Gov. Bill Walker nominated Roland Maw to the Fish Board in 2015, the board refused to interview him. She said she felt it was not very transparent.

Spohnolz didn’t seem to know that Maw had subsequently been indicted on felony charges related to Alaska Permanent Fund dividend fraud and theft, including six felony counts of first-degree unsworn falsification and six felony counts of second-degree theft.

Johnstone politely didn’t bring that up, but said the entire board of seven had decided not to interview Maw, and they didn’t feel that giving a reason was productive.

Rep. Chris Tuck wanted to know Johnstone broke hiring rules when hiring a coroner 25 years ago. Johnstone said he was wrong to have done so, and he had been rightfully admonished for not following established procedures.

Rep. Stutes then wanted to know how many times Johnstone had attended the Kenai River Classics, a fundraiser started by Sen. Ted Stevens to support fisheries conservation. Johnstone said hadn’t been for six or seven years.

“Did you in the past?” she continued.

Yes, Johnstone said, but he only attended the dinner, which he paid for himself. He didn’t attend the fishing portion of the event.

Stutes wouldn’t let up: “Did you pay for all your expenses?”

Yes, Johnstone said, he drove to Kenai and back at his own expense.

The accusations kept coming like a firing squad. Stutes and her sisterhood on the committee were going to take him down.

Johnstone is, for United Fishermen of Alaska, their number one target. Both Israel Peyton and Marit Carlson Van Dort breezed through their confirmation interviews with barely a concern from the committee earlier in the evening.

The governor’s nominee for the Fisheries Board then was the subject of hours of testimony from the public. The sports fishing community praised him, while the commercial fishing community damned him. Chairwoman Stutes quickly cut off the testimony of his supporters, while allowing those who oppose him to go on for another 15 seconds past the 90-second limit she had set at the beginning.

At the end of the list of commenters came Roland Maw, but he told the committee that perhaps he’d just not have anything to say at this time.

Chairwoman Stutes then read a four-minute scripted statement about why she opposes Johnstone, reiterating many of the points provided by the United Fishermen of Alaska. She represents commercial fishing interests in Kodiak and Cordova.

The inquisition ended after four hours. Supporters of Johnstone complained that while they got their letters submitted in time, they were not added to the committee packet. But then again, it was never intended to be a fair meeting.

Johnstone’s nomination to the Fish Board will be considered by a joint session of the House and Senate on Wednesday. It’s considered to be close.

In a joint session of the House and Senate this evening, House members opposing the nomination of Karl Johnstone for the Fisheries Board pulled the pin out of their grenade.

Rep. Ivy Spohnholz rose to claim she had been contacted by “more than two women” who said Johnstone had made inappropriate comments that were sexual in nature and that made the women feel uncomfortable. The allegations she made were from anonymous sources.

They were allegations that came after the committee process was completed, they never brought up before, and they were so outrageous that Sen. John Coghill, who serves as Senate Rules Chair, quickly stood up and called for a point of order before Spohnholz could continue.

“This is an accusation that has not been leveled in this building to my knowledge in any credible way” he said. “I would ask that we not go down that road,” he said. “This innuendo and accusation is out of line.”

But the damage was already done. Sen. Bill Wielechowski stood and asked that the nomination of Johnstone be tabled, and that vote to table passed closely, 28-27.

But before it was tabled, Rep. Sara Rasmussen rose to decry the injustice of bringing allegations forward that cannot be defended by the person being accused. There was no due process, she said, and as a mom of a young son, she worried about people making allegations like this against her own son in the future.

Moments before, Rep. Geran Tarr had plainly insinuated that the governor’s nominee to the Board of Education, Bob Griffin, acted like a “pedophile or kidnapper.”

Griffin had been doing a study on school bus routes, and someone called the police concerned about him following school buses.

Rasmussen also rose to object to that unfounded character assassination, and Tarr later apologized for besmirching Griffin’s character. His nomination passed.

Long-time observers say that in the past decade they can never remember the attacks against nominees being so personal, so nasty, so anonymous, and so unfounded. Republicans never made such unfounded and unsavory allegations about nominees of Gov. Bill Walker.

JUNEAU — The Alaska Legislature rejected two appointments by Gov. Mike Dunleavy to state boards and commissions after lawmakers said each may have committed misconduct not previously disclosed in confirmation hearings.

Meeting in joint session Wednesday to consider officials for state boards and commissions, lawmakers rejected Karl Johnstone for the Alaska Board of Fisheries and tabled a vote on Scott Flamme for the state board of veterinary examiners.


Speaking on the House floor, Rep. Ivy Spohnholz, D-Anchorage, said she heard from two women who said Johnstone made “inappropriate and unwelcome sexual comments” to them while previously serving on the board.

Spohnholz said the women “were not willing to testify on the record because of the fear of retribution.”

She later clarified by text message that they are afraid they would be the target of retribution if they made their claims public.

Sen. John Coghill, R-North Pole, and Rep. Sara Rasmussen, R-Anchorage, said it was inappropriate for lawmakers to discuss those allegations without giving Johnstone a chance to respond.


Sen. Bill Wielechowski, D-Anchorage, then asked to table Johnstone’s nomination.

That vote to table passed 28-27 with several members of the joint session absent, but lawmakers returned to the matter later in the evening and conclusively voted down Johnstone, 24-33.

Johnstone’s nomination had already been controversial and was fiercely opposed by the state’s commercial fishermen. He was strongly supported by sport and personal-use fishermen.

Spohnholz said said she learned of the allegations Tuesday.

When asked whether it was fair to levy accusations without giving Johnstone an opportunity to respond, Spohnholz said, “I think the legislative process is not well-suited to handling issues of sexual harassment."

Later in the evening, Rep. Geran Tarr, D-Anchorage, asked lawmakers to reverse a unanimous vote appointing Scott Flamme to the state board of veterinary examiners. Speaking on the floor, she said she had discovered multiple domestic violence restraining orders in his history on Courtview.

The circumstances of those orders were not immediately clear Wednesday evening, and Rasmussen asked lawmakers — as they had done with Johnstone — to table Flamme’s nomination rather than vote up or down.

By text message, Tarr said she doesn’t know what the Courtview records indicate and “was surprised by Rep. Rasmussen’s motion to table it, but I guess others felt concerned, too.”

In a subsequent text message sent after the initial publication of this article, she said it is possible the restraining orders may have been dismissed, but she felt raising the issue on the floor was the only way to have it heard before a final vote.

Lawmakers could take up Flamme’s nomination during another joint session, but if they do not, the House and Senate clerks said Wednesday night that they believe (based on a reading of state law) his nomination would expire with the end of this year’s legislative session.

The nominations of Johnstone and Flamme were among 104 cabinet, board and commission officials considered by the Alaska Legislature in a joint House-Senate session Wednesday. Most were accepted during floor debates that concluded after more than seven and a half hours.

CONFIRMATION PROCESS SLANDERED ALASKANS DURING JOINT SESSION

Two members of the Alaska House of Representatives are offering apologies on behalf of the body for the inappropriate nature of accusations levied against them during confirmation hearings.

Rep. Ben Carpenter (R-Nikiski) and Rep. Sarah Vance (R-Homer) issued apologies to the several appointees who faced offensive insinuations on the House floor.

None of the accusations, including ones made against Bob Griffin, whom a member baselessly insinuated was a pedophile, and Karl Johnstone, whom a member claimed had sexually harassed “more than” two anonymous women, had been brought up in the vetting process previously.

Several other appointees also had their characters impugned on the House floor.

“We extend our sincerest apologies to those who were slandered by our colleagues,” they said in a statement on Friday. “What we saw on Wednesday was not the level of decorum that we expect to see in the legislature.”


REP. BEN CARPENTER

“This was one of the most unstatesmanlike things I’ve ever seen anywhere, let alone in the House of Representatives,” said Rep. Carpenter. “I am gravely concerned about the chilling effect this behavior might have on future board nominees if we have a body that is allowed to engage in this manner. What sort of decent person will want to serve their state if they have to deal with nonsense like this?”


REP. SARAH VANCE

“Neither Rep. Carpenter nor I voted to confirm Mr. Johnstone to the Board of Fish, but our decisions had nothing to do with the unfair accusations levied against him on the floor,” said Rep. Vance. “To wildly throw out such offensive accusations with a clear intent to derail someone’s nomination is a sick political stunt, and I hope Mr. Johnstone and Mr. Griffin will accept our apologies on behalf of the body.”
