Very, very long story...
She was a Native Indian from Mentasta insisting she could fish ancestral waters for spawning red salmon.

Law said no. She won at court. 9th Circuit confirmed.

It went to SCOTUS but at the 11th hour the POS Gov, Tony Knowles dropped the case unilaterally.

We have been living under Fed management of our fish and game on Fed lands, which is by far the biggest part of AK. And we have allocation based on zip code and various other obviously unconstitutional things going on.

That is a very small thumbnail.

Many states had joined AK in the case at SCOTUS and there was very strong opinion it would be a real game changer. After writing briefs a number of States sued AK to get back the money they wasted and we paid out millions.

The Sturgeon case showed the Katie John case would have been overturned. But the SCOTUS simple said it did not apply to Sturgeon and let it stand. Some think the inference was a better case will link it.

It “spawned” the saying that re: fish and game, everyone is equal; some are more equal than others.

The Feds came up with numerous plans to give fish & game harvest preference to natives. So to make things look
unbiased or non-racial, some of we rural folks were included in some of the harvest. So now we have aliens [non-US citizens] enjoying
preferential hunting while life long Alaskans in the wrong Zip Code do not get the same opportunity. WTH?

And then we got the Community Harvest program.....................

Not to forget the Personal Use Fishery.

Absolutely! . But to each his own.

All in a day's work (if all goes well) - for my limit, of 35. Last year I took it easy and split it between 2 days.

Go ahead and froth the water all day with a limp stick for 3-6 fish daily if you con hook them, then land them.

I have other things to do.....

I would much rather process 3-6 fish daily than multiples of that, but oh, well. Into every life a little rain must fall.

Thanks for the answer Art. I am not in favor of giving special treatment to any ethnic group. I also do not believe in hyphenated Americans. I believe you are American or not. I never have told someone that I am Czech American. We should all have one set of rules period. People want to get all uppity about us taking the land from the Indians, but they were taking it from each other before we got here. There shouldn't be any reparations to anyone. When Rome took over a country they made them Roman's and they didn't rebuild nothing. If the native Alaskans want special treatment then dont give them an oil check. You shouldn't get it both ways.

Are there currently any good cases that are being brought through that would reach SCOTUS for a confirmation of a Katy John type ruling?

Oh it’s coming if the feds get there way and shut all of unit 13 federal lands to non subsistence users.. a lot of unit 13 is federal land.. ahtna native corporation will be happy with it, if it does happen.
