Majority opinion called the federal act 'a constitutional Trojan horse'

In a 4-1 decision, the Court of Appeal of Alberta has found the the federal government's Greenhouse Gas Pollution Pricing Act to be unconstitutional as it poses unlimited intrusion on provincial jurisdiction.

The appeal court decision, released Monday, rejects Ottawa's argument that regulation of greenhouse gas emissions is an issue of national concern, citing the division of powers in the constitution that gives the provinces responsibility for non-renewal resources.

The majority opinion called the federal act "a constitutional Trojan horse" and a "grand entrance hall into every head of provincial power."

Jason Kenney really socked it to Trudeau and the feds generally. Good for him. He did a good job of holding Liberal deceit up to the light. It was a campaign style speech, but it was well received and needed to be said.

From here, the feds will appeal and everything will end up in front of the Supreme Court of Canada. Kenney sent some warnings to the feds which will probably be ignored. Specifically, voting on citizen raised initiatives (like separation), and.

...his government would introduce legislation to protect what he calls "critical infrastructure" in the province, including railways. It (Alberta) would look at ways to directly invest in the energy sector due to "existential threats". His speech to the media was certainly put out for public consumption, but there was a message to Ottawa that the province is ticked. To me at least, it supports the idea that there are too many lawyers in all levels of government.

It says the legislation contains no limits on the scope of the federal government's power.

"What is authorized under the act indefinitely into the future and in the sole unfettered discretion of the executive is endlessly expansive," the decision says. "The executive's authority is also open-ended and largely subjective."

Justin Trudeau is a puppet. He has no special knowledge or skills to lead anything other than a class full of kids. I am serious. He was woefully unqualified to be PM but...

What he did have was the name. The son of a long time PM who came to power in the days of peace and love. The backroom boys of the Liberal party, the real power brokers, are using him. It got them back in power.

Like all governments, the Liberals will be replaced. Justin will be blamed for them being voted out.

These Liberal power brokers have the perfect patsy in Justin. He got them in. He takes the blame going out. Life, for the suits, goes on.

The bloom is off the rose for the Liberals, and has been for about a yr.
