How long did it take for his lawyer to get there and arrange for the second? Nope, I didn't forget. I saw that in the article and wondered about it. And how long does it take a body to burn off 0.06 BAC? Those are questions the prosecutor likely figured out so I don't have to. Not sure about Jersey, or whereever he was, but here, you refuse you lose your license.

Alcohol metabolizes at about 0.18-0.02 per hour (about one beer). So, it would take 3 hours to go from .08 to .02, assuming he was fully absorbed when the timing began.

In NJ you’re required by law to take a breathalyzer. A Limited defense involves proving the officer didn’t have probably cause. Basically, you refuse, you’re guilty.....unless you’re rich and famous. Then you can do whatever you want.

If you refuse the Breathalyzer in New Jersey it's an automatic loss of license for 6 months. If you are then convicted, the 6 months gets tacked on.
