Yes it is a case of mistaken identity. If the seller chooses to ignore the request to pull it out and see the underside then to me it will be misrepresented, and fraud / thievery. But I wouldn't call it fake. There are a lot of those examples floating about.
I would assume that the marking didn't look too bad when done; it probably became more noticeable after final polishing before blueing.
