Red Flag law needs to be put before SCOTUS and held unconstitutional, Red flag laws could POSSIBLY be constitutional, but they would have to provide sufficient relief/protections for the accused… is the state going to provide legal assistance? There would also have to be laws and severe repercussions for false accusations…a real can of worms our representatives just gave us….

I think most gun owners would be more open to red flag laws if there was due process, and criminalization of falsely accusing another individual out of hate, revenge or whatever included in the law..Also something in the laws to stop them from taking your guns away in a case of self defense, or in a case where you might have to threaten someone with a gun just to prevent them from trying to harm you... I'm all for taking guns away from criminals and mentally ill people that shouldn't own them...Sick of those types of people making responsible, innocent gun owners look bad...

I think most gun owners would be more open to red flag laws if there was due process. We've had that forever already. No need for a new law for that. It was the Red Flag actions that required new laws, since Red Flagging, by definition, refers to the act of denying people a fundamental right absent due process (and it's only due process if it has to happen before the action is taken). People deemed by courts to be insane or mentally incompetent have been denied the exercise of the right to keep and bear arms for about as long as we've been a nation. You just needed to give them their day in court first, before actions could be taken against them vis a vis their firearms. That's nothing novel, and no new laws are required for it.

I could easily see any new Red Flag laws ending up at SCOTUS. I've heard that lawsuits are already filed by GOA. And why hasn't the NRA filed suit yet? The NRA lobbies (bribes) politicians, the SAF files lawsuits. TheNRA funds lawsuits by others, mostly. All politicians take bribes, the guy with the most money wins as usual!
