I'd like to see the deceased rap sheet and know the history.
The guard is toast. If he were an leo, he would be ok. But a private guard shooting at a guy who lurches towards you in a vehicle, not going to get away with that.

Looked up the shooters name and found some articles. One claims the dead guy would come there to pick up pallets to resell. No mention of him having a criminal history or being accused of stealing from the property. The guard claims he had been trespassed from the property several times. The guard also was not licensed. Guard had every opportunity to not be in the front of that vehicle. He also was ordering the victim to leave the property, which he could have done by driving away like he was trying to do, maybe.
