In hindsight, my son should have made sure the ferrier was insured, as apparently she was not. There was really nothing to it, one of the horses she was shoeing got nervous and kicked at the other horse and hit the ferrier. She said she was OK, but packed up her stuff and left.
I told him it should be worker's compensation as well, FWIW. That's a clue.

She shouldn't have had the horse she was working on close to any of the other horses.

The ferrier is liable to have learned an important lesson for someone whose entire job description is fugging with horses “feet”….😂. The ferrier is liable to start looking for a different line of work if getting kicked by a horse is an unforeseen event for him.
Nobody has liability for a tradesman that doesn’t know what he’s doing. The ferrier should be embarrassed and apologetic for his mistake, not trying to blame a horse for doing what horses do when someone fugs with their feet. No schiet. We knew a farrier that would take no schiet from a horse that would not co-operate. He could throw them like steer wrestlers throw a steer, and they would lie still while he fixed the shoes.

My mama did our farrier work. She went to school for it. It was next door to Lug Nut College.
Anyway, I was in charge of “The Twitch” oh yeah mfer!! LOL
Turn their nose upside down with the numchuck looking thing if they got assy.

Homeowners liability will cover lots of things but generally will not cover a paid employee and depending on state law and/or maybe a signed agreement the farrier may not be considered a contractor. Maybe an employee albeit a temporary employee. Lots of times the law is what a judge says it is.

When I grew up we were taught never to pass behind a horse without letting the horse know that you are there. I'm not much of a horseman. Never owned one and haven't been on one since 2002, but somewhere in my youth I must have heard something like that, because I do the same thing.

So my son hired a ferrier to fix his two horses. One of the horses apparently kicked the ferrier, who was slightly injured, and later determined there were no broken bones. Is my son liable for the doctor bills, or is it simply the inherent risk of being a ferrier? Everybody know the horse liable to kick the blacksmith.. damn.

I carry an umbrella too, but that has nothing to do with my son's situation however. Appreciate the responses, right along with what I told him. He's a little stressed about it even though he did nothing wrong.

Twenty odd year ago, when I first started at the vet clinic down the street, they were all male vets (one was a US Marine Reservist) and mostly male techs. Gradually, over the last three or four years, they transitioned into an all female operation. One by one, the last remaining male vets and techs left, and were replaced by female vets and techs. Before the transition, no vet would ever tell me they couldn't do whatever they needed to do to my dogs (examine, vaccinate, draw blood, whatever). They'd establish dominance over them and do what needed doing. Now I get told that they weren't able to do this and weren't able to do that, and they prescribe powerful sedatives for my dogs and tell me to come back again so they can finish while my dogs are drugged out. That's BS. Get the male vets and techs back.
