F rating with the Better Business Bureau. Did you use a credit card if so dispute the charge, they will almost always side with the consumer.

To cut a long story short took my money, despite claiming they never received it & me having to contact my bank who confirmed that they most certainly did receive it, & have never delivered anything.




No unfortunately. At the time they told me their credit card terminal was down & i had to pay by bank transfer. More fool me.

I stuck the name into Duck Duck Go and found a web site but I noticed from it that they have no available address. Just a web address. Plus the web site looked like it was a bear to move through to find anything. Its probably someone working out of a garage taking whatever they can get with nothing or next to nothing to sell. The bbb good reviews are maybe the CEO and CFO. Sorry they got to you.

There was a heap of derogatory posts on the Optics & Ammo Facebook page last night & now they're all gone. Can't rip people off if they know in advance hey so best to just hide the evidence....

Someone needs to contact the district atty there and press criminal charges for "Deceptive Business Practices".

That is a felony under state law.

But because the fraud occurs on a national level, and interstate sales occur, there should probably be federal charges files as well.

Errrr of course he does, i ordered stuff from him that will never be delivered using my real name and real address... paid for them with real money as well. I'm to "Cease the harassment and defamation", and to Google his name and read about his litigation.

O&A shipped me a box containing a bottle of water instead of a Leupold. They then had "proof of delivery" when I
filed a dispute. My VISA is wise to them. Check out the out the owner and his multitude of lawsuits against universities

7mm did you use a credit card? Most will try to help in a fraud situation. Also the Attorney General's office has a department for this sort of thing. Might be worth an Email to them could pay off more than a FB p*zzing match.

The AG suggestion is not a bad one, Texas AG Ken Paxton has been aggressive going after shady companies that prey upon crisis situations and fraud/theft.

Long time lurker. Been doing some research on this character on line. I too have been in the process of being ripped off.

I may have turned the tables though as I instituted a CC charge back to which he went berserk and threatened to sue me for breach of contract.

I was worried until I saw all the overwhelming negative reviews.

To make a long story short, he's basically engaging in wire/mail fraud which is a federal offense. File complaints with the attorney general in his state but also file complaints with your local post office/postmaster. I believe you can do it online also at the postal service website. I would also contact UPS and FedEx as they are being used in the fraud. If you have VISA or any of the other CC, you may want to alert them too. Send links to the review sites to them if possible.

I have received one item so far but not the bulk of the order after 3 months. Terrible communication, all through text, out of stock inventory. He's selling items he does not have. That is fraud.

The bottle of water scope is a neat trick but that is also mail fraud.

This guy ripped me off also. I ordred an item that had been discontinued by the manufacturer and he never let me know till I started asking why it hadnt shipped. He either ignores my emails or gives me the runaround. Ive emailed him over a dozen times in the past 2 months. My suggestion is to call the Houston District Attny Office and file a fraud complaint, thats what I'm in the process doing. If they find that he's stolen more than $5000 it is grand theft and maybe they will go after him for fraud. In the meantime file a dispute with your credit card company.

After a couple of weeks of him just plain ignoring me i mentioned that i was going to contact the attorney general in Houston, this got a response from him where he said he would send me a refund check....the old check is in the mail ploy!!!

I said to him to ensure it was for the full amount to which he replied that "You get 92%, want to get sued?".

I of course rebutted saying i expect 100% as it was quite obvious that he never had the items in the first place, but he's taken it to mean i have refused the refund entirely & he is threatening to sue me for defamation.

Couldn't care less what he threatens to sue me for. I called his bluff about sueing me once before saying that there is no way in hell he'd ever want his dodgey business practices paraded in front of law enforcement & the courts which shut him up, but seems he's forgotten and reckons he's gonna go down that path again.

Anyway, i've given him a deadline of March 16th to get my full refund to me or i contact the attorney general. His move now, although i'm making sure i'm not holding my breath waiting for the refund to hit my mailbox.

I just checked his website and he still claims to have the discontinued Leupold in inventory.

The same one he claimed to have had when he shipped me a bottle of water.

I had the same problem with this company. Ordered a pair of binoculars on Jan 1 and the charge showed up on my card the next day. After a week of waiting I starated trying to call and email, they said they had a back order issue and was working on it. I checked with the binocular mfg and found that model had been discontinued for over a year but O&A still had it for sale. I emailed them again and they said would you like store credit so I asked for a specific rifle scope and they replied the next day that it was not available. So I started calling and emailing every few days for a refund to my credit card. They replied they could not do that because they changed credit card processors. This went on for almost 2 months. Finally I got with my credit card company and they reversed charges within a day.

The latest with my situation is that he was fighting with my CC company and claiming I got the order. LOL

I told the rep that I had only received a 25 dollar item with the rest undelivered. I paid for the item by check and that is it. For which he is claiming he never got.

The balance of the order he is now claiming was delivered to me.

The chargeback will stand. This guy is almost pathological. Like he doesn't even live in reality. He figures he can just keep doubling down on this stuff.

Well i got a response from the Attorney General which essentially reads that they'll keep my complaint on file in case they want to launch some sort of major fraud case against him, but for me as an individual there is nothing they're gonna do. Also be sure to contact the local sheriff and police. In a similar situation a few years ago it was the sheriff department that got the matter resolved. They are much closer to the situation and more likely to take an interest.

It appears he's instructing you to do a bank account transfer because he may have lost his vendor account with a credit card company. He has gotten charge backs like crazy. No CC company will put up with that from a vendor.

There you have it. All of my comments packaged nicely in one location. Now let's examine those against the circumstances and the the elements of the law.

First we must understand that the comments were made base upon statements members here and on the BBB site saying they had been ripped off. Second, we have to establish that my comments were made about him/her or the company. The above are the comments in whole. None of them even mention the company or him/her. Then we have to establish that the statement was false and purporting to be fact. Offering an opinion based upon information that is assumed to be true, even if it hasn't been determined one way or another, will never rise to the level of defamation. They were offered as opinions not fact. And that's just examining them against the first element of the law. There's much more trouble as you examine them against the other elements.

So here's the deal. If he can prove that he hasn't ripped off or engaged in shady business practices with the legions of people complaining online and with the BBB, I'll change my opinion. Hell, I'll even apologize.

In this day and age, there is no reason for an asshat like this to remain in business. He'll get his comeuppance, hunters/shooters are the type that are passionate about certain things, family and money being the two biggest. He'll rip off the wrong person and that guy might not have the family to reason with him to let it go and he'll pay the guy a visit. Hey guys, new here to the forum, all because of Optics and Ammo and Christopher Eustice.
He got me too. I ordered a cheap scope and rings on 4/4/20 to put on my Ruger 10/22
On 4/11 I hadn't been updated with shipping so I tried to call (no answer, left voicemail, it was never returned).
On 4/14 he emailed back saying "it" was on backorder. I asked which item, and if he didn't have the scope I need to cancel the order because it's a discontinued item that won't ever come back into stock.
He then did the offer of store credit or the 8% cancellation fee (for an item that said was in stock and wasn't, and never will be ever again), to which I refused and demanded a refund. He stopped responding after that.
I then started digging and found this forum, looked at the BBB and the facebook pages you guys listed here. I called my bank and canceled the debit card I used to order and got my money back that way.
Yesterday (4/23), he emailed me about a chargeback of $35 they got and wanted to see how to resolve it. I told him I submitted a fraud claim against him with my bank and explained my reasons.
Then, sure enough, he spent the ENTIRE DAY emailing me back and forth threatening me with collections and lawsuits if I didn't pay the $35, a $500 negative vendor review fee, and the original 8% cancellation fee for the $84.85 I spent originally.
So, essentially he has attempted to extort me for $541.79 or he would sick endless collection agencies after me, and sue me until "he owned everything I have". Also acted like he didn't lose all those lawsuits against Texas A&M, Chase, Equifax, etc.
Well, I'm not putting up with that crap.. so I filed a complaint with the BBB, the FTC, and the FBI's Internet Crime division (IC3), as well as the Texas Attorney General.
If he tries to sue me, I'll counter sue and I'll contact every single person he ripped off that he can find to join the suit to get this [bleep] shut down once and for all.
Just thought I would share my story. Thank you guys for keeping this thread alive so I could find it and confirm my suspicions and get my money back. Now I'm a lot more careful with EVERY website I order from and I won't order until I'm reasonably certain I'm not getting scammed.

I found two different addresses for him and 2 different phone numbers. Both addresses are houses, I'm guessing one is his parents because it's pretty large looking (google maps).

For the AG, I just googled Texas Attorney General.. it was the gentleman that was mentioned earlier in this thread, but I just filled out the complaint online. I'll probably call the Harris County Sheriffs department tomorrow and see if there is anything they suggest or anything they can do. It's unlikely anything will happen, but I'm hoping if enough of us complain that will be a red flag that will force them to look into it. If I hear anything back from any of the complaints I filed, I will update you guys.

I heard back from the Texas AG's office. It was sort of a form letter basically saying they'll keep it on file until there is enough reason to justify looking into it. I recommend every person that has been ripped off by him file a complaint online, maybe if they see enough about this guy they'll be forced to look into it. Haven't heard anything back from FTC yet.

Well This guy also got me . He sent all of the same threat emails regarding the collections and small claims suits. Upon closer research of this guy I find it hard to believe that he even has time to participate with O&A since he is always filing law suits against someone or another. Check out the Houston Court Docket calendar. Hes tried to sue many companies and failed and is still in the process of suing some credit card processing company and a heating and air company for work performed 11 years ago. I also think that his father is also involved in many of these suits. I've been in contact with the Harris County DA office and advised by them that the first step is to file a report with my local police dept and have it sent to the HC Sheriff dept. That way their dept. will look into it and hopefully file some charges against O&A. So I suggest anyone that's having the same issues with O&A follow suit. (Squeaky wheel gets the oil)

Reviving this old thread. Apparently dirtbag is still in business. Do not deal with him unless you like getting F-----ed over I ordered from him and never recieved the goods, then when I contacted him her just offered store credit but when I tried to order he said those items were discontinued, when I asked for a refund he said he had changed credit card companies and could not refund. I ended going to my credit card company and getting the charges for my purchase reversed. This went on for about 3 weeks before I reversed charges, then I got emails from him threatening to sue for doing that.

I found this forum while trying to gather info on Optics and Ammo after being scammed by the owner for about $500. Had the identical threats of lawsuits mentioned by others after asking for a full refund on a discontinued product listed as "in stock" on the website. Have started the claims process with the cc company, and will be contacting Houston law enforcement in the morning. Misery loves company, so it's good to see I'm not the only one.

What surprised me is how long the cc company told me the process could take...45 to 60 days to resolve the issue. They're also using snail mail as their primary form of correspondence. Will definitely be printing a small book worth of info on this guy to send back to them in order to rectify this thing as quickly as possible.

Contact the local DA office. I had a problem with an auto repair insurance. Contacted them several times and wanted a refund to which they refused. It only took one call from the DA office and I got a complete refund. But you have to contact the DA office.

I told him if he was a legit business he’d be able to pull my invoice from the order number I gave him. I’m going to call today and get the charge reversed.

Yeah I've received a couple more emails from him. This time it was this exact email and amount. Before it was $500 fee I think and 8% cancellation fee. I've ignored him and been too busy to get down to the local PD and do something about it. I doubt they'll follow up with Houston anyway, but maybe if I get a day off during the week sometime soon I'll get to it. I haven't responded since April 24th, and he's still threatening to sue and put me in collections. I figure if he was going to, or had a way to at this point he would have. The best case is they'll tell him to stop contacting me or maybe I can get him for harassment. I haven't blocked him just so I can document how many times he does it.

I have been following this thread, though I haven't done business with this guy. Actually, I think there is a 3rd option: This guy may be Looney Tunes. At my advanced age, I have met a few folks, whose cheese has slid off their cracker. They don't think like most people. For example, years ago I supervised a project for which night security was needed. The company that won the contract was warned that a security guard sleeping on the job was cause for loss of contract. Well, it happened not once but twice (2 different guards). Now, I'm talking "pound on the vehicle side glass to wake up" sleeping. After each incident, I contacted the owner directly, who assured me it would not happen again. After the 2nd time, I gave him the bad news but also told him to submit his invoice, so that I could get him paid for the work performed. Over a period of 6 months, I tried several times to get this guy to submit me an invoice so I could pay him but all I got was how I was a bully, unfair, etc. To borrow somewhat from the X-Files motto, "They're out there".

I called my CC company and reported the fraudulent charges, and his threatening email came on 06/30/20. I’m glad I found you guys. Let me know if you need me to call and make a police report. I know at least three people got swindled trying to buy those tracers. I’d go on the previous page and leave a voicemail for that investigator. He’s going to have you fill out a consumer complaint form and get it notarized. Welcome to the forum. Tell him to go fist himself. He doesn't have enough time in life to follow through on 1/100th of the chargebacks he gets.

I'd be interested in knowing how much money he has "on hold" at any given time. If he kept that money in an interest bearing account, and the amount was significant, he could be profiting nicely off of the customer's money.

You can add me to the list of people scammed by Optics and Ammo. I was able to dispute the charge and got the money back.... and that's when the emails started. I was just ignoring them for a few months, but the one he sent on 7/2/20 was more aggressive and threatening than the previous correspondences. I reached out to Investigator Maxwell (listed on page 10) this afternoon and he could not have been more pleasant and understanding. He is aware of and very familiar with our situation, and offered to help however he could. If you're on the fence about contacting him, don't be. Super nice guy.

He did advise me of a history of the scammer using the bank/credit card info for additional fraudulent purchases, so make sure to check your bank account and request a new card if you have't already.

Good luck fellas. Karma is a bitch, and I'm pretty confident he'll get what is coming to him.

I placed 2 orders thru the site. Requested information multiple times and he wouldnt respond. When he finally text me he wouldnt give me anything, just ignored me. I then text and said i was canceling my orders. He started the threats then.

My update: papers have been filed with the investigator. Continued boilerplate emails from Eustice/opticsandammo. I would encourage everyone to work with your credit card companies, contact the detective listed elsewhere on this thread, and contact the manufacturers of the products you tried to purchase directly. Let them know what happened. I personally wouldn't have any interactions with Mr. Eustice going forward, but I guess choose your own adventure.

For those that don't know, OpticsandAmmo has been sued for trademark infringement by Vortex. The case is pending in the Southern District of Texas. It's case number: 4:20-cv-02304 SHELTERED WINGS, INC. D/B/A VORTEX OPTICS v OPTICSANDAMMO, LLC, and CHRISTOPHER DAVID EUSTICE

You can view the documents in PACER: https://pacer.uscourts.gov/ but there is a small fee after viewing a certain number of pages per quarter, I believe. Keep that in mind. Don't throw good money after bad, but it is cheap entertainment if you are looking for it. His "motion for an extension of time and sanctions," filed in response to Vortex's complaint, is kind of interesting in that it reveals some of his ""business model."" (double air quotes, as I am using this term loosely) The parties are currently fighting over whether he can proceed pro se (corporations have to be represented by an attorney in federal court), and over an extension of time. Some highlights, from OpticsandAmmo's motion:

On the business model -

"The Defendants have tried to work with Vortex Optics over the past 4 years, but Vortex Optics wants to bully small business owners because they do not have the resources necessary to open up a physical storefront as required by Vortex Optics. The Defendants have thus engaged in wholesale purchases with many authorized Vortex dealers such as such as BHPhotoVideo, OpticsPlanet, Cabelas, and others. All of these vendors offer B2B Sales Programs and Discounts for Business Purchases. All of the listed products, regular prices, images and product descriptions used on the Defendants website originally were provided to the Defendants by BhPhotoVideo in the Fall of 2016. BHPhotoVideo informed the Defendants that they had the full rights to use their images for advertising and the like. It possible the Vortex Optics listings have become outdated, because the Defendants have to manually update 35,000 products by themselves in addition to running the day to day operations of their company. The Plaintiff seems to fraudulently deny the fact that their own authorized dealers make B2B sales of their products. Vortex Optics is not entitled to a Monopoly over the resale of their products. This would run contrary to all common law and legal knowledge."

On the need for an extension of time -

"To further support the extension of time to respond to the Complaint, the Defendant provides the following facts: Somebody very close to the Defendants passed away recently, the court was closed on Friday July 3, Defendant has been locked out of his ECF account and is trying to regain access, Defendant's neighbor's dogs chewed through the Defendant's internet cable which had not been properly buried by AT&T, Defendant is currently dealing with final exams and other many other stressful and time consuming commitments. Furthermore, the case has been pending due to COVID-19 related court disruptions and that should also be fully considered.

Defendants respectfully request for an extension of 30 days time to respond to the Plaintiff’s Complaint. This time is necessary to allow the Defendants some additional time to find the expensive legal counsel which they are currently unable to afford. This will also allow some additional time to research the many complexities of intellectual property law in the event that the Defendants proceed in this case Pro Se."


I highly doubt B&H granted a guy in his house in Houston the "rights" to use everything on their website. I wonder if B&H knows about this? He claims to still be a student. I wonder if whatever university/community college he attends knows about everything going on?

Bottom line: he has no money and has resorted to "I need more time to learn the laws I've broken" and "the dog ate my cable connection"-type arguments. (Vortex's attorneys note that Eustice has filed these arguments in other cases across a length of time in which the cable should have been fixed.) Infer from that what you will...

I hope Vortex and their atty are aware of the wholesale fraud this guy has made as a daily usual business practice.

It's hard to imagine when the guy sleeps, he's got so many lawsuits going at any given time, issues with credit card companies, supposedly going to school, sending threatening emails to dozens of people, and a bodybuilder on top of that??

While it would be wrong to claim all the credit for Vortex taking legal action, after the asshat referred to in this thread diddled me out of my hard earned money over a simple Neoprene Vortex Spotting Scope cover, i just might have sent them a message asking them if they knew this clown was using their products to rob people! I'm not sure who suggested it first, or on what thread (I've done a lot of "opticsandammo reading" online this year...), but I think it is fair for "the internet" to claim some credit. This is from Vortex's complaint in the case I mentioned above:

"42. Defendants are not Authorized Dealers of Vortex products.

43. Despite not being approved as an Authorized Dealer, Defendants have
purportedly sold and continue to offer the sale of products bearing the Vortex Trademarks on the OpticsandAmmo Website.

44. Upon information and belief, Defendants complete orders and accept money from customers, but do not actually ship product to customers.

45. Multiple consumers have contacted Vortex regarding negative experiences attempting to purchase Vortex products through Defendants’ OpticsandAmmo Website, complaining that Defendants charged them for Vortex products and then never sent the customers the products they ordered.

46. Defendants are engaging in deceptive sales tactics intentionally designed to divert sales from Vortex and Authorized Dealers, even though they have no intention of shipping any Vortex products to their customers.

47. OpticsandAmmo has an “F” rating on the Better Business Bureau website. A true and correct copy of the Better Business Bureau profile for OpticsandAmmo, LLC is attached hereto as Exhibit C.

48. More than twenty-six (26) customers submitted complaints to the Better Business Bureau regarding Defendants’ business practices. See Exhibit C."

If you contacted Vortex, good job! I did not purchase a Vortex scope from OpticsandAmmo, but I contacted that manufacturer of the product I did purchase and told them about my experience. I also told them about this lawsuit. I encourage everyone to do the same.

The Vortex complaint reminds us about trademark law. This whole clusterf-ck is the reason you have authorized retailers. If you visit the optics counter at Cabelas, whoever you interact with has been visited by someone from Vortex, Leupold, Swarovzki, Zeiss, etc. to train them on their products. Manufacturers routinely send "secret shoppers" to stores to check up on their products, how they are being displayed/marketed, etc. Manufacturers also monitor the business practices of their retailers.

When you deal with a "normal" retailer like Cabelas, Bass Pro, B&H or even Optics Planet - despite whatever issues we've all had with them (and I've had mine) - you normally get what you purchased. If it's backordered, there is some normal way of dealing with it, like providing a time estimate or not charging your card until it has shipped (or not offering it for sale in the first place!). I believe this is - at least in small part - due to manufacturers policing these "authorized retailers." If they totally sucked at their business, they would not be authorized retailers.

We were all duped by Eustice / OpticsandAmmo. I've read others say something like "Yeah, the website looked a little sketchy but...," and I felt the same way. Yet there was something about it that made it just legit enough to start entering those credit card digits. I think Vortex is right to say that it was their trademarks, but more importantly the goodwill associated with the mark that they've built up over the years with their authorized retailers. The trademarks listed on the "our brands" section of his website, and the professional (because they were taken from B&H) photos made it look quasi-legitimate.

Eustice needs to be stopped. He's hurt a lot of people. He's smart enough to do all of this, but there are definitely some mental health issues going on. I might cut a young guy some slack for being awkward around women, but after reading a lot of the papers in the LSU lawsuit, I worry there's a chance he could hurt a woman.

So anyhow, I'm fighting in my own way. Considering sending B&H's corporate counsel an email and let them know what Eustice just filed. I bought some binocs from B&H once. Refreshingly normal transaction with a receipt, a tracking number, then binocs showing up on my doorstep. That is how it should be.

Finally, I own several Vortex scopes. While I think they are a pretty good value, in truth they aren't my favorite. That said, I'm sure there's something kicking around in the safe that could use an optic. Yes, they are made in SE Asia, but there are real people outside of Madison, WI that work for Vortex (Eustice threatened to sue all 300 of them, by the way...).

I will support a company that goes after business practices like this.

CDB is right. If you're in a retail location that's close to a corporate office or close to the home of a field rep, you MIGHT get them to come by and train you.

I worked @ the Scheels in Grand Forks ND and we didn't see anywhere near as many reps for training as they did in Fargo just 80Mi down the road. The Scheels Corporate offices are in Fargo so obviously the reps would go there but only a very few would drive just over an hr. to train @ another store unless it was on their way to/from somewhere else.

I had both charges reversed with my cc company. Just got a notice from the cc company that he’s challenging the larger of the two. His response to them was tracking number “n/a” was delivered on “n/a”, should be easy to let them know that the “n/a” he put meant nothing was actually shipped. Also I did respond to his threatening email letting him know that if he’s represented himself in 175 civil cases it was in fact him who is at fault. He really got pissed when I asked him about how his cases were going against his colleges. 🤣🤣🤣 I wish I could’ve seen his face when I brought up his home address and asked if he did indeed live in his mom’s basement! I let him know that there were forums all over the internet calling him out (never mentioned a specific one) and they all have been in contact with Mr. Maxwell. He’s been silence ever since.

Wonder what would happen if someone in the area showed up to the small claims trial with sufficient evidence to arrest a perp on fraud charges and asked the small claims judge to have the bailiff arrest a perp in light of the evidence presented and that s/he be held without bail until trial to prevent further harm to society.

Also, discovery in the small claims case could be very interesting, particularly if the defendant was able to explore potential pattern of behavior by plaintiff.

I googled an attorney to represent firearm/defense and several popped up in DFW stating they support gun rights/owner rights, maybe there is one local to Harris County that does the same thing? Background: I am being frivolously sued for roughly 10k the max allowed in Small Claims. He is using the breach of contract angle and harassment. - Both of which he has nothing solid, but he is doing this in an attempt to harass me.

The down side is he literally files hundreds of frivolous lawsuits in an attempt to weaponize the court systems and use vexatious litigation to suppress, harass, and oppress people. He is infamous in his county. They can't stop him from filing these lawsuits so he abuses the privilege regularly. The court that he is located in does not allow virtual or telephonic presence in hearing so you have to show in person which may be another reason he abuses this power. Eustice is continuing to defraud customers on his website and make money while giving sworn testimony that he cannot afford court and serving fees for documents. - He even brags about getting away with this in his case in Louisiana. This allows him to perpetually abuse the courts for his gain.

I have reached out to a lawyer in Harris County and they mentioned that he is deranged and files lawsuit on people all of time.They mentioned that he brazenly stalks lawyers and defendants by sending them crude picture or pictures of their homes.

This is going to be a suck fest for sure but I am not going to give in. I hope that through my case I can expose his criminal history and hopefully he will be brought to justice.

I'd show up and hand the judge a copy of this entire thread, as well as hand written statements of people that have been defrauded by this guy, as well as the statement by the BBB about all the complaints they have gotten.

Might not hurt to have some e-mails from law enforcement you have reported to about the fraud.

If you do that, you should win handily, and quickly.

I would ask for fees as well, as the winning party.

Just received a letter from my CC company, he is challenging my dispute with them. I have made copies of everything to include a phone record of my call to him in which of course I only received voicemail. It is sad that the criminal justice system will not sport this idiot. Here are some important things some of you may have missed. He is charging SALES TAX on purchases which I doubt he has paid. Also in his shipping time he states 2 business days. No other online sales site I have ever been to will let you order items that are out of stock. Not Walmart, Target, etc. to include any sites selling ammo that I have been to. They will let you sign up to be notified when they are available but will not take your money.
His site will let you order assuming that it is stock, very deceptive!

Just discovered that a case he had against JP Morgan Chase Bank on Leagle.com website has been dismissed WITH PREJUDICE. Don't know if JP Morgan will go after him for Legal Fees. Also his case with Texas A&M that i found on Justia US Law Eustice v Powers has been DISMISSED WITH PREJUDICE also. On Rokslide.com someone stated that they found that he lost his case with Vortex and was hit with $32,000 for Vortex's Attorney Fees. Also on Rokslide someone stated that the reason that Harris Co DA has trouble with prosecuting him is that either people will not fill out the paperwork or they have received their money back through their CC company.
He must be getting desperate because he has challenged my CC company to get the money back that was returned to my account. I have a feeling that he will be trying to sue everybody right now because he world is crumbling.

If you can get a copy of him lying to your bank i.e. saying you agreed to accept store credit or something to the matter, that is an additional offense and should be reported to the DA. If the person who who received the water-bottle in the mail is willing to file with the DA and higher that particular crime is federal and can go to the DOJ. Fun fact: Eustice uses a pauper's claim on all of his court filings to get out of paying court fees. This allows him to continuously abuse the court system and file frivolous lawsuits at no cost to him, but at a cost to taxpayers. If someone were to know the right people in Harris County District 5 and bring up an investigation, there may be a case of additional fraud and lying under sworn testimony.

So I just came across this thread after searching for info on this delightful human being and I'm shocked to say the least. It looks like he has now moved past taking peoples money via his website and is now either using their cards or just stealing numbers to make purchases for himself. I work for an online ammo retailer and he placed a $1000 order with us recently and then a few weeks later I get a card dispute from the actual card owner.

We have some safe guard policies in place when a customer specifies a different billing & shipping address and we asked for some proof of his connection to the individual who's name and address in New York that were provided for credit card billing. He went so far as to send a fake bank statement to us with his name inserted with the billing address. We said "hey, that's still not the name of the guy who paid for it" so he sent another bank's statement with the correct name and address. The sales associates in the office aren't super sleuths and he provided what we asked, so it got shipped out.

I'd love to get in contact with Samuel Maxwell, the investigator mentioned in this thread who is aware of the issues if someone could PM me the email. If not, I can call in and see if I can reach him, just wanted to get right to him and hopefully get some charges added to this guy.

Add me to the list of victims. Ordered 500 rounds of federal 5.56 last week and paid with a direct bank transfer from my checking which I NEVER do, but I needed ammo, he said his credit card link was down and his price was decent considering the current environment. I checked my order status and saw it had been on hold for 7 days. I checked with his bank and confirmed he had received the funds the same day as the order. I started getting suspicious and googled Optics and Ammo and felt really stupid that I had been duped this easily.

I emailed his support account and did not receive a reply. I emailed it again the next day and called the number listed and finally received a reply later that day. "Feel free to mail a check or money order for your order total to the following address." When I replied that he already had my money he sent the following: "Our suppliers have increased their prices and we will need some additional funds from you before we can ship this order out"

I told him I was going to give him one more opportunity to either refund my full purchase amount or send me the exact product I have already paid for in full within the next 48 hours or I would be reporting him to the Texas Attorney General, the Harris County DA and the BBB. He has sent me three emails making the same threats as everyone else has been receiving. I live in DFW, so I have no problem driving to Houston and appearing in court to testify as a witness if we can get this clown before a judge.

Like an ill running car this guy sorely needs a major tune up.

Update:

Eustice had 66 items filed alone in his regional JP court from 2017 till now. He apparently has many other cases in state, and federal courts. I have been able to pull all of his cases for JP justice of the peace and it appears he files motions over and over again terrorizing churches and his victims, and also attempts to get default settlements against large companies. When he loses he files affidavits saying he cannot afford the penalties and tries to stretch out appeals. I am filing motions against him in my county to turn the tables on him. I have brought up the issue that he is receiving income from various sources and filed a motion to have him go before a judge and explain why he has sworn that he cannot pay court costs. I have submitted documentation where he has openly admitted in other courts that he files small claims cases all the time and can do it for "free" in his area so he will have to explain that as well.

I appreciate all of the contributions to my go fund me.So far I am about $400 deep in court and service fees and will spend another $300 for a PI to get a comprehensive background check of all of his court cases, criminal cases, police reports, and Arrest Records.

If anyone has additional information to contribute, Private Investigator / Legal contacts / recommendations or would like to contribute $$ to the cause, That would be super helpful.

I am more than happy to share any documentation that comes from the PI.

Keep meticulous records to include screen shots showing the product in stock.

Just spoke to the DA, he is very close to being able to move on Felony charges. He has to hit a certain dollar amount to take the case to court.

He said he will file this month if he can get enough people to fill out the paperwork and respond. He said he has spoke to over 200 people but only had 40 follow up and fill out the necessary paperwork.

If you have not followed up with the DA this is the time.

I've been in contact with him as well, just need to get the complaint form notarized and then we'll have lots of documentation showing credit card fraud / document forgery on the way back to him.

Thankfully I just came across this thread. I phoned the DA this afternoon (probably a bit after hours, or close enough to EOD for them not to respond yet). Add me to the list as another victim. I, too, was duped by product that did not appear to be in stock many places.

I hope to hear back from the DA in the next day or two. I will be happy to follow up with whatever is necessary.

Order product, no shipment. Request refund, refund denied with a statement to reference insane return policy. Pursue dispute through bank, Eustice sends angry emails, lies to bank. Etc. Leaving out specifics in a public forum, but seems to be par for the course with this guy.

Yes, currently showing in stock and I have documentation that it was showing in stock when ordered, as well as documented in stock multiple times between then and now. Sitting on almost 50 files documenting everything so far.

My apologies for being somewhat vague in the public thread, but I tend to be, based on what I do. I've documented this situation from when I placed the order several months ago up to today, catching him in several lies in the process, including his official response to the bank regarding my dispute.

Now THAT"S what I am talkin' about! If nothing else I'd file a small claims suit against him for tying up your money. That is if you can do that in your jurisdiction.

Posting this information up for those just now finding this thread, Chris has done a ton of the leg work, he has also laid out the groundwork to hopefully get this guy shut down.

I have helped him financially and would do it again for any other member here if a predatory business went after that member. We all work hard for our fun money and hopefully we all learn to be more diligent in the future because of this asshat.

If he collected sales tax for your state then they will know if he remitted it to them. Make it enough and they will go after him.

Has anyone received threatening emails as of late. I have dogged him hard about a refund and he has gone radio silent.

He is probably busy getting schooled and losing court cases. His latest lawsuit where he tried to enforce his "Terms and Conditions" and "Fees" was dismissed with prejudice in civil court.

He is trying to sue individual employees of Vortex in small claims court for no reason. He incriminated himself in emails to the company lawyer and his LSU Cyber Stalking case got refiled as Stalking and is coming up in JAN.

Just received an email form the BBB of Houston. They stated they are sending this email to all who have had filed a case against snowflake that is unresolved. It is correct, the DA has filed a case against him.

I just submitted everything I had to Maxwell along with the complaint form he sent me to fill out. On the form you can either print it out and fill it in by hand or type it in on your computer. One thing though, on the Affidavit it has Harris County and State of Texas. If you do not live in Harris Count and Texas you have to make changes on the form. You can do it very easily on you computer because the form is in MS Word and you can make the changes. I found that out when I went to get it notarized, Individual wouldn't do it because they are not a notary for Texas and she refused to line out and handwrite the correct information in. You can either go to your bank or your Insurance company (mine has a notary), if you have accounts with them there is no charge.

Optics and Ammo owner Christopher Eustice was in jail yesterday. Charge was Aggregate Theft. It is a State Jail Felony. That means he can serve no more than 2 years , no less than 6 months. but it is day for day. No parole.

Hey everyone, I received an email back from Maxwell, he informed me he is very busy because he claims that Eustice has scammed over 1,000 people and informed me that the more people that send him information the better. Think of it this way, one of his charges will probably be mail fraud, with every person that takes the time to send their information is an additional count. Would it be better to have only 50-100 counts or several hundred counts. If we really want to put this guy away for a long time then everyone needs to help. From all the posts I have read many of you have do not like him any more than I do. He is a real scumbag we all know that, lets all help make him somebody's B_ _ _ H!

So as of right now, per Eustice's Bond agreement, he is not allowed to be on the internet.

He didn't make that retroactive did he? He can't hold you to terms that were added AFTER you ordered and were stiffed on the goods or refund. I imagine at this point the dollar amount of fraud would push it into a criminal category.

Interesting ploy. It will never survive judicial scrutiny. You can't defraud people of their money, and then say they agreed not to try to get their money back once they find out they've been defrauded. Not to mention, he had no intention of ever honoring the sales contract, so why should the people he stole from be held to its terms? That he is preemptively trying to forestall a class action suit is an admission that he knows he has ripped off a lot of people.

I think the guy's got mental health problems, in addition to his criminal nature.

Starting off I’m new here, and almost got had but I knew better, this guys website is the ONLY place with ammo in stock online with big box store prices, so I knew something was up, researched and of course a slew of this type stuff came about. This guy is definitely a sociopath/psychopath, I’ve read a deposition from the judge and lawyers when he sued the 2 LSU students... the amount of emails he sent their lawyers is crazy, and the context of them. And also someone mentioned earlier that their serial killer alarm went off, and he’s correct, this guy fits, and interesting enough he had not 1 but TWO roommates while at LSU with suicidal ideations🤔 that’s a little concerning. One actually did commit suicide and the other attempted. What are the odds of 2 LSU students living with the same person commit suicide or try to.
