A judge on Thursday rejected the Arizona Senate’s motion to dismiss a public records lawsuit relating to its independent full audit of ballots cast in Maricopa County in the 2020 election.

The lawsuit was filed by watchdog group American Oversight and sought records of communications between Senate officials and external vendors working on the audit, including Florida-based cybersecurity firm Cyber Ninjas, a private company hired by the Arizona Senate to oversee the audit of Arizona’s most populous county. It also sought documents related to the cost of the audit, donor information, and its operations.

“It is difficult to conceive of a case with a more compelling public interest demanding public disclosure and public scrutiny,” Judge Michael Kemp of the Arizona Superior Court in Maricopa County wrote in a seven-page ruling (pdf).

Kemp said that he “completely rejects” the arguments presented by the defendants’ lawyers.

“Nothing in the statute absolves Senate defendants’ responsibilities to keep and maintain records for authorities supported by public monies by merely retaining a third-party contractor who in turns hires subvendors,” Kemp wrote.

Keeping the election audit records private “would be an absurd result and undermine Arizona’s strong public policy in favor of permitting access to records reflecting governmental activity,” the judge said in his decision.

Kemp said records on who is funding the audit should be released to the public, saying that the $150,000 the Arizona Senate is paying Cyber Ninjas “appears to be far short of paying the full cost.’’

“The public does not know who is financing the remaining costs,’’ he wrote.

Meanwhile, Democrats on the House Oversight and Reform Committee on Wednesday launched a probe into Cyber Ninjas.

In a letter to (pdf) to Cyber Ninja’s CEO Douglas Logan, House Oversight Chairwoman Carolyn Maloney (D-N.Y.) and Rep. Jamie Raskin, (D-Md.) said they are probing whether the company is working to “reverse the result of a free and fair election for partisan gain.”

The pair asked for documents related to the audit, including information about how it is being funded. They are also asking for any and all communications between the cybersecurity firm and former President Donald Trump or his allies.

Cyber Ninjas, Fann, and former Arizona Secretary of State Ken Bennett, a Republican serving as the audit’s liaison, didn’t immediately respond to requests for comment.

Fann previously told The Epoch Times that senators had been told by Cyber Ninjas that the auditors would report on the total cost of the operation after the audit is complete and that they would comply with federal reporting requirements.

The only path to destroying the audit is to muddy the waters so much that they can make people believe there was criminal intent on the republican senate's part in funding an audit. Truth is the audit cost a lot more because the county wouldn't allow the facilities to be used for it and they in turn had to rent the stadium. It took a lot longer because of all the stonewalling on the county's part. Kemp is culpable and cannot afford to have it known he confirmed a rigged election. The entire country is anxiously awaiting the audit results. How we got there is pretty much moot at this point. If I have to donate more money I'll do it so Arizona won't be out any more of their precious money than necessary.

If the Supreme Court had only allowed the suit we wouldn't be here in the first place. All the states have standing in a national election. Rigged elections hurt the Nation. This one surely has.
If the audit shows issues - watch for the call to be to audit the audit. The plan is drag this out until they can completely bury it in the national consciousness.

If there's one thing I've learned in my many years on this planet, it's that you cannot shame, embarrass or point out their hypocrisy to a true liberal. They don't possess the gene of self-introspection, and they are certainly incapable of genuine bias-free critical analysis.

With all of this in mind, ALL legislative action in Washington D.C. should stop. Now that the credibility of the honesty of the election is in doubt, all legislative processes, debating, voting and bill signing SHOULD STOP IMMEDIATELY.

It's obvious that Arizona and Georgia may of held flawed elections and the wrong person was certified. It's probably the same in Pennsylvania and Michigan. Until all issues have been resolved, everything in Washington D.C needs to stop.

IMHO, the audits should go on......... they need to be exposed.

The idea of removing Biden and putting in TRUMP is not going to happen.

There is no US Constitutional provision, mechanism, process that elects a POTUS by a popular vote of the citizenry.

The States had their electors cast their votes and Biden 'won'...... Each State needs to deal with the process.

Again, there is no provision in the Constitution for the States to say after the fact, 'our bad, we messed up, here's the right numbers' and get it all undone. IMHO.

I wanted TRiUMPh in the Office again, I don't want him to get back in with an abbreviated term.

What if it takes two years to determine the resident of the White House was not legally elected and he is removed from office and the legally elected President serves the last two years of this term. Is Trump then eligible to run for election in 2024 thereby serving 10 years as President of the United States of America?
Allowing the candidate that was put into office to remain there after fraud is proven is about as far from just as you can get. It is true tyranny if allowed to continue and yes the Constitution has a path to fix that...

The lawsuit has nothing to do with the actual audit, only the funding *for* the audit.

So that the liberal Brownshirts can hunt down and kill the real Americans that helped fund a search for the truth.

This was my thought as well after they said if Biteme served 2 years and stepped down or died that Hairyass could serve out the remainder of his term and still be able to serve 2 more full terms.

I kinda figured that things will get sporting right about the 1 1/2 year mark and at the 2 year mark we would actually see a major move on somebody's part Dumbocrat , Rebublipuke or Patriot's

The few people on American Oversights staff that I looked into all came from hard left/progressive backgrounds (I know big surprise right?). I can understand why the guys running the audit don't want to give them anything. You know damn well tey are going to run to the media with the worst possible spin on it.
