He's riding a wave of support, and while the memory is fresh in the minds of the public that the establishment just attempted to railroad an innocent young man into prison would be a bad time for the Feds to press charges against him. That would be extremely bad optics for the administration. If he lays low, and memories get stale in the public mind, the Feds might feel more at ease about another railroading effort.

Backing down and capitulating is not a good battle plan. How much further do we need to back down? While that’s true, any Civil Suit will be judged by a “preponderance of the evidence”. A lot lower standard of proof then a Criminal Trial.
All his Attourney has to do is show evidence from his Criminal Trial. Easy win for Kyle’s Attourney. He will counter sue and win any Civil Suit. More money for Kyle and his attorney.
