Milwaukee prosecutors are conducting an internal review into their own office’s decision to make an "inappropriately low" bail recommendation for Darrell Brooks Jr., the person of interest in nearby Waukesha after an SUV plowed through a Christmas parade.

The horror left at least five people dead and 40 injured – including 18 children rushed to Children's Wisconsin hospital in Milwaukee.

Brooks has multiple pending cases in Milwaukee County – including a 2020 case involving two counts of second-degree recklessly endangering and being a felon in possession of a firearm, according to a spokesperson for Milwaukee District Attorney John Chisholm. Bail was originally set at $10,000 and later reduced to $7,500, the district attorney’s office said.

But due to a court scheduling conflict that would have deprived Brooks of his right to a speedy trial his bail was again reduced, this time to just $500, which he posted on Feb. 21, 2021, according to prosecutors.

Earlier this month, Milwaukee authorities charged Brooks with another reckless endangering out, felony bail jumping, battery, obstructing an officer and disorderly conduct. He allegedly ran a woman over with what may have been the same SUV that wreaked havoc on the Christmas parade. He was released on $1,000 cash bail on Nov. 11.

"The State’s bail recommendation in this case was inappropriately low in light of the nature of the recent charges and the pending charges against Mr. Brooks," Chisholm’s office said Monday. "The bail recommendation in this case is not consistent with the approach of the Milwaukee County District Attorney’s Office toward matters involving violent crime, nor was it consistent with the risk assessment of the defendant prior to setting of bail."

The DA’s office said an internal review of the bail recommendation decision is underway.

In a recent case, a woman told police that Brooks charged into her hotel room, shouted profanity at her, and took her cellphone before driving away. He allegedly circled back later, found her walking to a nearby gas station and punched her after she refused to get into his car. When she started to walk away, he allegedly ran her over with his vehicle.

Police arrested Brooks at his home at 4:25 p.m. on Nov. 2, according to the criminal complaint, which also notes that he owned a maroon Ford Escape with license plate ADP 9256. He ran into the home in an alleged attempt to evade arrest after authorities ordered him to

The complaint also said the victim had blood on her face, a swollen lip and tire tracks on her pants.

Court records show that just days later a Milwaukee judge ordered him to stay away from two women in connection with the case – including one who he had already been told to avoid but was present at the time of his arrest.

On July 24, 2020, Brooks allegedly shot at his nephew, according to another criminal complaint, following a fight between the two a day prior. Police arrived at Brooks' home after receiving a ShotSpotter alert but said he had already left the area.

The nephew escaped injury, and Milwaukee police arrested Brooks the next day, court documents state.Brooks' attorney on the Milwaukee charges said he has not currently representing Brooks in connection with the Waukesha parade incident and has no plans to do so in the future.

"Our hearts are broken for all families affected by the tragedy at the Waukesha Parade," attorney Joe Domask told Fox News Digital Monday. "The Waukesha community is dear to our hearts here, and we joined in their sorrow. And we keep all those affected by this incident in our thoughts and prayers."

Regarding the charges in Milwaukee, he said he is still representing him, "at the moment."

This time (different county) they are asking for the amount to be so high he cannot make bail. I read in Wisconsin a suspect cannot be held without bail.

Exactly. The point is, he should NOT have been on the streets to begin with. But activist DA's want to put this garbage back into circulation as fast as the police can arrest them. This is what catch and release gets us. I hope all who witnessed this will remember why it happened and hold those accountable for it.

I’m going to tell you all what happened, though I doubt any of you will listen and would prefer to blame the DA. It’s already happened a lot and is going to continue to happen a lot over the next few years with guys a lot worse than him.

Covid f-u-c-k-e-d the courts just like it did the supply chain. In most places, but especially places like Wisconsin, there have been few to no jury trials over the last year and a half. Some states have very strict speedy trial rules and just because there haven’t been any jury trials, doesn’t necessarily mean that speedy trial doesn’t apply. This still is all to shake out. There is not a Covid exception contained within any state or federal constitution.

Many states have a rule that says that the trial MUST occur within one year of arrest or the defendant MUST go free and the charges MUST be dismissed. Now, for various reasons Defendants will often ask for a continuance and they will waive their right to a speedy trial and the time limits will toll (stop) until restarted at another date. But guess which guys almost NEVER want to waive their speedy trials and almost always want to proceed as fast as they can? That’s right the guys in jail. That way they can either get acquitted or get on to serving their actual time in a real prison where they might get more good time or better food and exercise than they do in the county jail. The food in many county jails is absolute rock bottom like bologna and a piece of bread at every meal kind of bad.

Anyway, as things start to start back up there is an incredible backlog of cases. And it isn’t as simple as courts and attorneys working more. You have all the court personnel who would have to be paid overtime and you have all those juries which must be empaneled and paid. But even so, some courts are trying two or three jury trials a month which is close to the absolute maximum that can be done. Naturally, given the speedy trial requirements the worst offenders are to be tried first.

Which brings us to this guy. He had a long rap sheet and it looks fairly serious. But frankly, there were a lot worse in there who need to be tried first. So, this guy had a speedy trial issue and his case was about to be dismissed. Do you keep him in with a high bail and try him in lieu of one of the many murderers and rapists who also need to be tried soon? Do you keep him in jail and risk having to dismiss his case completely if you can’t get him tried? Or do you give him a low enough bond that he can get out and agree to continue his case and waive his speedy trial rights until you get time to deal with him?

You guys have no idea how bad the courts have been broken by all this mess. They weren’t in the greatest shape to begin in. Good luck trying to get a contested divorce hearing, they’re all busy hearing criminal cases. In one three month period (I forget exactly which one) in Texas in 2019 there were over 5,000 jury trials. In the same period in 2020, there were 4. Yes, four over the entire state. That is a lot of justice delayed. And Texas is a lot better off than many states because Texas does not have a speedy trial rule with any teeth. So, a lot of these dilemmas that are hitting other places are t quite having the same effect there.

On other platforms the consensus is , this story is MSM’s spin to give this guy cover from a hate crime. “He was driving at high speed because he was fleeing a knife fight”. Lots of people have his racist posts screenshots. He clearly meant to do what he did.
