Good luck with that. There is no provision in Section 3 of the 14th Amendment to allow removal by legal action. This Section 3 specifically allows removal by a 2/3 majority vote of both the House and Senate. So to me, this is just a scare tactic aimed at those that will not take the time to read the Amendment and understand the implication.

DEMs are not thinking smart about this sort of thing. If they try to remove any elected official over an "insurrection" when not one person has been charged with it then the GOP can demand the same thing be applied to any DEM member of congress that was involved in the protests when Trump won office and that would include Pelosi, Schiff, Waters, Jackson Lee, Schumer, Cohen, Nadler, Raskin, Durbin etc... The standard would have to be applied equally in order to be legal and the DEMs aren't thinking along those lines.
