My guess is they will dismiss it and nothing will happen. Don't upset the status quo. The rule of law no longer applies. I hope I am mistaken.
The reason the government did not respond is because this has no chance, It is stillborn.

The Supreme Court won't accept the Writ.
The judicial system has had several opportunities to hear and rule on cases that would have significantly reinforced the Constitution as the supreme law of the land. They mostly refused to hear the cases so they wouldn't have make a ruling consistent with the Constitution. When they did decide to hear a case, their ruling was the narrlwest possible interpretation neccessitating additional cases to enforce the original ruling. At all levels and branches of government the corrupt outnumber the constitutionalists.

My understanding is one justice , I would guess Thomas, requested the case. Then at least 4 justice's have to agree to hear it.
And if the past is any indication they will reject it.

Justice Thomas is one of the good guys and a constituionalist judge. We need several hundred more just like him.
