Technically you are correct. However, don't forget that Comey's term doesn't end when Obongo leaves (the FBI Director has a 10 year term). If he puts his foot in his mouth and publicly states that she hasn't broken the law or there isn't sufficient evidence to warrant a referral for an indictment, (don't forget ... neither the FBI of the Justice Dept. has the power to "indict" ... that comes from a Grand Jury), it will be pretty difficult for him to do a 180 and recommend an indictment if a new (Republican) administration takes office. There would have to be new facts or evidence.

According to statute, anybody involved in any of those email chains with classified info were guilty of felonies.
Would the net have been too big, making the fallout too dangerous for either party to push? Maybe dragging in too many top bureacrats and career politicians from both sides of the aisle? Comey's choice was simple; He could recommend prosecution and see his recommendation disregarded by Lynch, or take Lynch off the hook by not recommending prosecution.
He knew, just as anyone with any sense also knew, that there was no way in hell that the PTB - R and D alike - would allow an indictment of a POTUS Nominee. So, of course the fix was in from the git go.
The "people" have it in their power to correct this gross miscarriage of justice in November. The fact that the "people" are not likely to punish Hillary, either, will prove Comey's wisdom in refusing to be a worthless sacrifice.
