Jury Rules Against Dad Trying To Save His 7-year-old From Gender Transition.

DALLAS, Texas, October 21, 2019 – A jury in Dallas, Texas has ruled against Jeffrey Younger, the father who is trying to protect his seven-year-old son, James, from chemical castration via a gender “transition.” This means James’ mother, Dr. Anne Georgulas, will be able to continue “transitioning” him into “Luna,” and now has full authority to start him on puberty blockers and eventually cross-sex hormones.

The jury’s decision likely means that Mr. Younger will be required to “affirm” James as a girl, despite his religious and moral objections, and will also be forced to take a class on transgenderism.

With a consensus of 11 of the 12 jurors, the jury decided not to grant Mr. Younger Sole Managing Conservatorship over his two twin boys. They voted that the current Joint Managing Conservatorship should be replaced by a Sole Managing Conservatorship, but that Mr. Younger should not be that person. Judge Kim Cooks will read her ruling on possession, child support, and Dr. Georgulas’ other requests at 1:30 p.m. CST on Wednesday.

Mr. Younger and Dr. Georgulas were in court last week fighting over custody and decision-making abilities for James and his twin, Jude. Mr. Younger argues his ex-wife is “transitioning” James against the boy’s will.

Dr. Georgulas, who brought the lawsuit, was asking Mr. Younger’s possession schedule be altered to decrease overnight stays and to force his visits with the boys to be supervised. Dr. Georgulas brought the original modification suit to the court and did not request a jury trial. Mr. Younger, in his counter-petition, asked for a jury trial. Since Mr. Younger requested the jury trial, the jury ruled on his specific request for Sole Managing Conservatorship and the judge ruled on all other aspects of the petition as brought by Dr. Georgulas.

She was also asking that Jeff be forbidden from calling his son James – his given and legal name – and that he be prohibited from bringing James around people who do not “affirm” James as a “girl.”

Mr. Younger was asking to be granted Sole Managing Conservatorship of the boys, meaning he would have had complete authority over medical, psychological, and other decision-making for the boys.

The jury did rule that one of the parents should be Sole Managing Conservator – but that it shouldn’t be Mr. Younger.

Before this case, Dr. Georgulas had complete authority over psychological care decisions for the boys. She was required to inform Mr. Younger of her decisions, but he did not have any say in her choice of care.

Last week, the arguments revolved around James’ diagnosis of gender “dysphoria,” medical records recommending he begin the process of preparing for puberty blockers, and expert testimony about the risks and alleged benefits of puberty blockers and cross-sex hormones.

Mr. Younger is worried about Dr. Georgulas forcing a lifetime of misery on their son. Transgender-identifying individuals, even when encouraged in their confusion, suffer from more psychological issues than the general population, have shorter lifespans, and are more likely to commit suicide.

Expert witnesses testified to a child’s inability to fully comprehend the potential side effects of such therapy, such as permanent infertility, inability to ever naturally engage in sexual relations, and a decreased lifespan.

On Friday, protesters called on Texas lawmakers to pass legislation making it illegal for anyone under 18 years of age to begin a medical transition. They argued that children cannot fully understand the lifelong consequences of their decisions and parents should not be allowed to make this decision for their children.

Currently, there aren’t any U.S. laws that restrict the use of puberty blockers or cross-sex hormones or outline a minimum age of administration.

Dr. Georgulas testified today James and Jude are not actually biologically related to her. They were created through in-vitro fertilization and the couple used an egg donor.

It’s known as Munchausen syndrome by proxy, and while Dr. Michelle Cretella, ACP’s executive director, admits that she can’t make an honest and accurate diagnosis simply from news headlines, the child-abuser in question, Dr. Anne Georgulas, M.D., of Dr. Anne Pediatrics in Coppell, Texas, could very well be projecting her own mental illness on her young son, Dr. Cretella says.

“This case is consistent with a diagnosis of Munchausen by proxy,” Dr. Cretella told the media. “This is a disorder in which an adult feigns either physical or psychological condition in a child for their own subconscious reasons. Most often the perpetrator is the biological mother and she often has a background in health or medicine.”

“In the case of imposing gender dysphoria on a son, there are cases in the scientific literature of severe maternal depression triggered in a mother longing for a daughter. The mother’s depression lifts when the boy dresses and acts as a girl. This has been termed ‘gender mourning.'”

Dr. Georgulas may be investigated for plans to sexually mutilate her son with hormone drugs and surgery

It’s definitely a stretch, but could be a possibility. The father of Dr. Georgulas’ son James, a Christian man, has been doing everything he can to win custody of his son, who he says prefers to wear boy clothes and do boy things when he’s not under the influence of Dr. Georgulas.

Regardless of whether or not Dr. Georgulas is mentally ill herself, young James should obviously never be under her guardianship, nor should Dr. Georgulas be allowed any contact with the boy as she’s a clear and present danger to his mental and physical health.

Keep in mind that Dr. Georgulas is ready, upon getting the green light from the courts, to physically mutilate young James with hormone drugs and surgery to make him appear to be a girl, which represents a form of physical assault and rape against his biologically male genitals and male genetic makeup.

“In the father’s home, James appears to be a normal boy and doesn’t identify as a girl,” says Walt Heyer, a speaker, author, and former transgender individual who now runs the website SexChangeRegret.com.

Walt Heyer, who ultimately rejected his own transgender life as a female, reports at the Federalist that he has researched the case of James:

The transition therapist has observed that James is not consistent, insistent, or persistent in the desire to become “Luna.” For example, a dossier filed with the Dallas court says that, under the skilled eyes of the therapist, the child was presented two pieces of paper, one with the word “James” and one with the word “Luna,” and asked to pick the name he preferred. When the appointment only included his mother, James selected Luna, the name and gender he uses at his mother’s home and in his first-grade classroom. When the appointment was only with his father, however, James pointed to the boy name James, not the girl name.

The court, however, has prohibited James’ father from dressing him as a boy or from sharing faith-based or biologically-based scientific teachings on sexuality, even though, as Heyer reports, family friends who have observed James when he is in his father’s care affirm he dresses and behaves as a boy by his own choosing.

James’ “transition therapist,” however, continues to identify him as “Luna” and to place him on track for gender transition.

In his book, Trans Life Survivors, Heyer shares first-hand stories of misdiagnosis of gender dysphoria and its “heart-breaking results.”

“A questionable diagnosis locks a vulnerable child into an alternate gender identity long before they can understand what is happening or where it might lead,” Heyer writes. “It’s up to the adults to observe the child carefully, consider and question the grey areas, and ultimately guard innocent children against hasty diagnoses and conclusions about something so fundamental as their gender identity.”

As a Ph.D. biologist, I find the whole concept of "transgendering" (as well as individuals who decide that they are "transgendered"} to be nothing more or less than serious mental illnesses. Your sex is determined by your set of X and/or Y chromosomes, not by your mindset.

To subject an innocent child, who has no way to make an intelligent choice in the matter to psychological and/or physical "transgendering" is both heinous and cruel.

They gave her sole managing conservatorship but the judge was ALWAYS going to get to make the conditions about any medical treatment.

Now what actually happened is actually better than that even. Joint managing conservatorship is the default position in Texas. In order for someone to get sole managing conservatorship, a number of conditions must be proved. A motion was made by the father’s counsel and the judge apparently ruled that jury had erred in its determination and concluded something not supported by the evidence as presented.

I’ve said since I heard about this case that no court in Texas was going to let a mom force a seven year old into a sex change, and it didn’t. Now, in my opinion the court could have gone farther and restricted mom’s visitation.

I wonder if the child had an ad litem or amicus attorney and if there was any court ordered evaluation by a neutral psychologist.

Why are you talking about the jury and then talking about the order when they were joint managing conservatorship before the jury trial?

Link me to the order. It didn’t say what you’re saying it said. Like all Texas orders it had a list things that each parent could do. For joint managing conservators the list is exactly the same. To someone, like you, who doesn’t know his ass from a hole in the ground when looking at one, I can understand how it would be confusing. Hell, I’ll admit that Texas orders are ridiculous and waaaaay too long. But anyway, it will list all of one parents rights, then in an identical section list the others. For JMC it’s the same.

Here is a procedural history of the case if anyone is actually interested in what actually happened:

1). They were never married. Yeah, you heard that right. Their marriage was annulled by petition of the mother. I can’t even begin to tell you how rare annulments are in Texas. I can’t even think of one I’ve ever actually seen. What that means is that by a finding of the court, the father is a liar. It means that he lied about certain material facts that induced the he woman to marry him;

2). They had two children during the “marriage”. They were awarded joint managing conservatorship. That is true joint legal custody. That generally means exactly equal rights and responsibilities in all respects. The only difference is that the child will generally, but not always, live with one parent or the other. And the other parent will receive standard visitation. The parent who has the child live with him will have the exclusive right to “choose the geographic location of the child.” It’s been said that the mother was granted the right control to exclusively control the child’s medical treatment in the first Decree of Annulment. I doubt that based on how I just explained JMC works, but even it was the language I’ve seen people quote in refenrence to this story was “after notice”. Why is that important? Because if moma says “Hey, I’m gonna have Johnny’s dick cut off” dad can rush out and get a court order stopping it

3) At some point moma decided her boy was a girl and disagreements arose. Eventually mom filed a motion seeking to make dad treat the kid as a girl or restrict his visitation if he didn’t. She didn’t try to change from joint managing conservatorship to sole and specifically she didn’t seek to gain the unilateral right give the he child hormone therapy or surgery. In fact, she did the exact opposite and asked the court to enter an order that such measures could only be undertaken by express written agreement of the parents;

4) Dad naturally objected to being asked to call his boy a girl and filed an Answer and a Counterpetition. In his counterpetition he alleged that mother’s actions constituted child abuse and asked to be named sole managing conservator. He also asked for a jury trial. Most child custody cases are tried to a judge and the mother had not requested a jury trial.

5). So when they eventually had the jury trial, the jury heard the case and gave mom sole managing conservatorship. Remember, she hadn’t even asked for that in her pleadings. It’s like a prosecutor asking for five years and a jury giving the defendant 50. The jury was not asked to rule on any of the other issues regarding custody and those were left to the judge.

6). The next day, when the judge came back, she ruled that the jury had exceeded its authority and granted something not asked for by the parties and that the jury’s finding was contrary to Texas law as it fit the facts. She kept JMC, granted mom’s motion to make all hormonal and surgeries require written consent of both parties, noted that despite the hysteria, there was never any danger of that happening, she denied mom’s motion to have dad refer to the kid as a “she”, ordered the parents and the child into counseling, admonished them to shut up and grow up, and gave them a gag order on the case. She noted that regardless of what else happens to this kid, the publicity has been and will continue to be for many years, very harmful to him.

That’s it. From what I can tell that is a pretty concise procedural history of the case.

As usual, much less interesting when you know the facts behind a case.
