As we all know it has a long Picatinny-style rail and a rear peep. Is there a way to scope it and keep the peep? See attached for picture.

Either use an EER scope and forward mount it, or get used to crawling the stock to get proper eye relief. Even then you would have to use see through rings or detachables to be able to use the peep.
First thing I did was pull the rail and front sight, plug all the sight holes with stainless plugs and put a stainless blank in the dovetail slot. Plenty of good choices for scope bases for Marlin.

Those do not fold "flat" to facilitate scope use.
Yeah, had my doubts even with the "folding" nomenclature, but he mentioned "XS" sights without model info "that fold down". Don't see any XS sights that "fold down". What up rem141r??
You could try taking the "folding" rear sight off your M4/AR15 and seeing how that works. Taller see thru rings?

I bought the 1894 CSBL and was wrestling with the same issues. Last night I threw a Leupold one-piece picatinny mount for an AR-15 on it ... dang thing clears the ghost ring by almost a quarter inch. I think by adding as strap on or velcro cheek piece to the stock, it's going to work out ok. No reason I can see that it wouldn't work on the .45-70, too.
