I can't see where he would be prosecuted, it sounds like a legitimate use of force in defense of another's life.
He may not be prosecuted, but before it's over, I'll bet he feels like his efforts were not worth the trouble he will go through...

Maybe, but this thought process has always been why some people do, and some people don't. I'm pretty sure that most heroes don't weigh their wallets before they jump into something.
