Last weeks ruling on the Tax stamp was about Pistol braces?

And what about SBR’s? What is the process to buy and own and transport SBR’S?

Conversation between three guys the other day showed none of us were real clear on this issue….

Walk me through this please.

The NFA is still in effect (although it shouldn't be) and pistol braces are legal to purchase and own without registration.

Form 1 , $200 stamp. Last I heard they were still running close to a year. Some considerably less so time wise it's a crap shoot. Most states transport isn't a big deal, if it's going across state lines it has to be declared in advance.

Any guesses as to whether or not they’re still processing all those forms? My money is on “betcherass”.

Don’t have one, but I woulda tossed a brace into a river and waited to see which way the wind blew rather than volunteer for a screwing.

For an SBR it's a 1 time $200 when you file.

And, you can’t take an SBR across state lines without a “mother may I?” From ATF.

All in all, the pistol brace rule saved a lot of bull stuff.

You need a Form 1 to make a pistol into an SBR, because adding a stock is “manufacturing” and SBR out of a pistol

A trust allows more than 1 person to legally have the NFA item in their possession.

An NFA item that is personally owned must always be in that persons possession.

Trusts make it easier, at times, to setttle an estate but it's pretty easy to do a Form 5 tranfer (free) when a person dies to settle the ownership of the NFA item.

Buying the complete SBR would be a Form 4.

There’s some of the confusion,

I've always been told form 4 if it's a complete sbr / sbs.

Yes.

If a FFL07/SOT manufactures a SBR it is then registered with the BATF on a Form 2 and kept at the place of manufacture.

It can only be tranferred to another FFL/SOT on a Form 3 or transferred to a person in state on a Form 4.

If a person wishes to make their own SBR by attaching an upper w/ short barrel to a lower they already own then they EFile a Form 1. After paying the tax stamp and getting approval they engrave the lower with their name, city/state, and a serial number.

Now they can legally attach the short barrel upper onto their lower.

Form 1s are typically quite a bit faster approval, usually less than 45 days.

John laid it out pretty simple.

I built a pistol lower complete with a pistol RE so the brace wasn’t even a concern. This allowed me to buy a 11.5” Colt upper and shoot it while I was waiting on my approval. It also allows me to take it across state lines on the pistol lower.

My form 1 e-file took about 45 days. Form 4’s are running about a year. There are threads that track wait times on each form type on arfcom, M4C and Reddit usually in the NFA sections.

I had my SBR lower engraved but since it already had a serial number, just my name, city and state was required.

Lots of them I’d bet. My suppressor was 182 days I think, a buddy got his in 8 days and another friend waited over 11 months. You just never know but the form 1 SBR is the fastest way right now.

Anyone selling NFA item's knows the game and long hold times are just part of it.

Keep in mind, while you're waiting they have your money AND your gun, so all the risk and interest expense is on you. With the current AFT purge of LGSs this is not a small risk, so chose your NFA dealer carefully.

Yep, we had one get robbed and finally shut down, ATF got involved heavily and the guy was caught. It was a mess for those that were waiting on approvals.

My 1st suppressor approved on 05/18/23 after 273 days.
My 2nd suppressor approved on 10/18/23 after 202 days.
My 3rd suppressor submitted on 06/19/23 and has not yet been approved. 154 days.

Form 1 is easy and usually a lot quicker than a form 4 for complete SBR or suppressor. For a form 1, just buy the upper and lower separately. File the form 1 with the serial number from the lower. Once approved, you can then combine the upper and lower legally. Form 1s have been taking about 30 business days lately.
