If I sell rifle ammunition to a resident of NY am I legally required to ship the ammo to the buyers FFL?


My biggest fear is when I die my wife will sell my guns for what I told her they cost.

I'm not a lawyer, or FFL holder, or law enforcement, or Yada Yada yada....

BUT, I looked up and read the law, and my understanding is that if you are a commercial seller you cannot ship directly to an individual. You have to get registered with NY as an ammo seller and have to ship to a NY FFL or "registered seller of ammunition" who then has to run a background check on buyer.

However, didn't see any wording that applied the law to private transfer of ammo between individuals. So, kind of vague on that point. Somewhere in the NY codes is a definition of "ammunition seller", but I haven't had inclination to dig it up.

Here's an extract:
7.No commercial transfer of ammunition shall take place unless a licensed dealer in firearms or registered seller of ammunition acts as an intermediary between the transferor and the ultimate transferee of the ammunition for the purposes of contacting the statewide license and record database pursuant to this section Such transfer between the dealer or seller, and transferee must occur in person.

Notice wording "commercial transfer"? All this clear as mud?

Good thing our case is going through the Courts now, and should it reach SCOTUS seems likely to toss that scheidt out the window having seen what Bruen has done.

NYS requires a background check to purchase ammo. cost passed on to the purchaser.
Can be any price the dealer wants to charge .

not sure there is any provision either way for personal sales.

The NYS set fees for background checks are $9 for firearms and $2.50 for ammo. If you've actually experienced dealers charging any amount they want to you should report them to your Sheriff or the State Police.
