I have an idea. If a guy wants to avoid getting shot by a cop - he might start with not going on the attack....regardless of what tool he is or isn't presently carrying.

To me, it goes without saying that if you drop the hammer and do what the cop says, you most likely won't get shot by the cop.

The use of force progression does not have use every individual step. I can go from the command drop the hammer to shooting just that quick. Also not all officer have tasers.

I'm no expert on the Force Continuum used by police departments. But in a previous life I was trained on one in the realm of embassy security. It went kind of like this:
- presence - verbal commands - soft empty hand technique - hard empty hand technique - soft baton technique - pepper mace - hard baton technique - deadly force
Our general rule of thumb (below deadly force) was to be two levels above someone we had to deal with.
ROE for deadly force would include being attacked by any form of deadly weapon, which would easily include a hammer.

In today world with all the different tools, the Force Continuum could get fairly complicated, and common sense/instinct can likely takes over under stress.
A sensible way to streamline would be simply:
- verbal - soft techniques - hard techniques - deadly force

Legally, there is no requirement to try lower levels of force even if the officer has tools readily available. The question is whether or not the officer reasonably feared his life was in danger. If the facts stated are correct the officer's use of force was legally justified. -Z
