it all goes back to did the officer feel in fear for his life. I kinda think I would be, if a hammer wielding crazy guy was after me.

Just to be clear: Old Toot brought in a second instance of a cop shooting. One in Oklahoma and the other in Louisiana. Let's not get the details of the two mingled.

And while you're watching to make sure he doesn't hit you with the thrown hammer, who's watching your back?

I have an idea. If a guy wants to avoid getting shot by a cop - he might start with not going on the attack....regardless of what tool he is or isn't presently carrying.

Very good FreeMe. That's a point I hadn't considered. Is the crazy guy with the hammer by himself?

To me, it goes without saying that if you drop the hammer and do what the cop says, you most likely won't get shot by the cop.

Is this your typical bad cop bad shoot post or are you fishing for a campfire consensus?

I would've talked to him in a stern voice while maintaining eye contact and simultaneously drawing my cocabolo nunchuks.

Just curious, but will the cop be required to justify not using his TASER first?

The use of force progression does not have use every individual step. I can go from the command drop the hammer to shooting just that quick. Also not all officer have tasers.

Play stupid games, win stupid prizes.

I'm no expert on the Force Continuum used by police departments. But in a previous life I was trained on one in the realm of embassy security. It went kind of like this:

- presence
- verbal commands
- soft empty hand technique
- hard empty hand technique
- soft baton technique
- pepper mace
- hard baton technique
- deadly force

Our general rule of thumb (below deadly force) was to be two levels above someone we had to deal with.

ROE for deadly force would include being attacked by any form of deadly weapon, which would easily include a hammer.

I've got a hammer like that. Haven't been able to find ammo for it since O get elected.

In today world with all the different tools, the Force Continuum could get fairly complicated, and common sense/instinct can likely takes over under stress.

A sensible way to streamline would be simply:

- verbal
- soft techniques
- hard techniques
- deadly force

Maybe in the court of public opinion. Legally, there is no requirement to try lower levels of force even if the officer has tools readily available. The question is whether or not the officer reasonably feared his life was in danger.

If the facts stated are correct the officer's use of force was legally justified.

Thanks Gents, just wondering how things worked over there..Here's its likely the Bobby responding would not have been armed with a firearm, so would likely have used pepperspray and/or a Tazer..

Friggen cops are so worried about their own safety. Why didn't the cop just fight him for the hammer. No regards for citizens safety only their own...

Will Munny: It's a hell of a thing, killing a man. Take away all he's got and all he's ever gonna have.

The Schofield Kid: Yeah, well, I guess they had it coming.

Will Munny: We all got it coming, kid.
