The president cannot declare war but he and his administration can put us in a position where we are at war. This entire mess about the drone is insane in that it puts us in a situation where we are perceived to be at war. Everybody knows it. we've made no attempt to deny it. We have been financing Ukraine in this conflict. We could've stopped it at any time, but we didn't. We want war and by God, we'll have it if we have to shoot a Russian aircraft down in Ukraine to get it.

The point is, it would at least provide an argument on the world stage against us. Further, given the sensors available, there is really no need to violate airspace or for that matter, airspace as defined by who? Is the Crimea (for example) RECOGNIZED as Russian air space or is it a disputed geographical position in a war zone( I'll let you figure that one out). As for the drone issue. If you're sending military equipment into a war zone that is intended to contribute to killing one side of the warring factions, it's only reasonable to expect that warring faction to destroy it, given the chance.

Taking out a drone is no different than shelling a HIMARS position.

Because if your plan is to loiter in international airspace just off a conflict - NOT having offensive weapons on the platform signals a LACK of aggressive intent to those in the conflict.

Imagine the political/public hay that could be made by the Russians if it had missiles on it or had engaged their pilots in some way with offensive weapons/radar.

The exact same arguments some here are making for why we shouldn't stand by while the Russians splash our bird would be made by the Russians for why they had to splash the bird. Hostile intent by a foreign power in international airspace gives them the political cover to simply blow it up.

Once you actually arm the thing - people get nervous. Shoot it down or you shoot at them because they're engaging simply hot dogging/reckless flying and THATS how the WW3 starts.

We've had proxy wars since the 40s and as far as Congress, the War Powers Act SHOULD be challenged by Congress in the courts...That said, in my OPINION, there does need to be some wiggle room for the President to act quickly, like for example when the gooks seized the Pueblo, even though we didn't do crap and we were well within our rights to do so..
