He is in a heap of trouble.
I know of more people who have been killed by texting drivers than by drinking drivers. GD
Fines for holding your phone in your hand as a CDL driver run as high as $2,750 for the driver AND $11,000 for the company........ and yet it still happens.

Nuts.
I drove the Big Rig for 8 years, including many trips to this area, I was on I 20 near Midland and Odessa.
Eight years ago it was made illegal for CDL drivers to text while driving, illegal to even hold a cell phone in the hand while driving. That is why I bought a $165 head set.
If you were caught, automatic $2500 fine and 6 points towards your license. One ticket like that and your driving career was in jepaordy.
In spite of that, and I was still driving two years ago, every day on the road I saw at least one driver sending text messages while driving the Big Rig.

This driver is really up the creek. His driving career is over. He will no doubt face felony charges, vehicular homicide etc. Texas doesn't play he will probably get several years jail time.

And then there is civil court. There is going to be a lawsuit and, I know from cases involved in the company I used to work for, they will collect at least $4 million. Maybe more.
Minimum mandatory insurance is $750,000. If this company only has the minimum, and the award is $4 million, they will then go after the assets of the driver.
I hope is doesn't have a valuable house that is all paid off because that will be lost in the civil suit. Also if he has a nice expensive paid off pickup, he can say bye bye to that.

So look at this driver, probably he is from out of town. He will be travelling back there to Kermit Texas for the next year, fighting the criminal charges, and he will shell out at least $50K in legal expenses. And he will still go to the Texas Pen for years.
The civil suit will happen while he is in jail, and his house and truck will go bye-bye. His wife will probably leave him or, if not, she will at least have a new boyfriend or two. He will be just about unemployable.
His life will be destroyed.

I have zero sympathy for this driver. He deserves everything he gets. What a tragedy. What a cute little girl. This story makes me sick.

I never understood the popularity of texting. If I want to talk to someone I know I just call them.
Texting. Talking. Listening to radio. fidgeting with AC or radio. Day dreaming. Being tired.

I've seen em all cause wrecks. I simply cannot say that one is worse than the other from what I"ve seen with fire and EMS

That said if you text constantly or read the faux book constantly that would be different. I"m not sure why people would be that stupid.

OTOH talking was what got me pulled over for speeding the other day. Had no clue how fast we were going or what the speed limit was. Wife and I were just in a deep conversation on the way to watch a rifle match.

Some people just don't get it. He will be made an example of, it will be big news but some just won't learn from it. He may end up with a boyfriend or two himself.

Yep. Too much complacency. If it was my daughter, that guy would need a police escort to keep me from cramming that phone down his throat and out his ass sideways.

I've had to dodge being run over as a pedestrian so many times that I gave up keeping track, and nearly to a driver, they had their head in their phone. Should be self-defense to shoot a driver after I have to dive out of the way to keep from being hit by a driver staring at their lap or jabbering away.
Everyone is focused on how fuct the driver is.

I text and drive all the time.
Last summer I damn near had a "texting trucker" put me in the ditch. After I cleaned the schidit out of my pants I passed him and he was [bleep] with his iPad as it rested on his steering wheel.
I've personally seen more than a few cops texting and driving on my old commute to work. One was the day after MN cracked down hard on it.

It has its place, when you're in situations where talking is not possible, try talking on a Ph when you're on a location with multiple big diesel engines running 24-7 and you have to wear hearing protection, or you're in a meeting, theater, etc. If I'm driving I simply pull over and text for the simple reason I don't want to get in a voice conversation with someone who's going to run on and on.

As I passed them in the right lane, I saw they were texting on the Iphone.

Somebody ahead swerving 3 feet across the lane divider. I could look in the window and see they were texting. It is easy to look into a car from up high in the big rig, and it is difficult to look into the big rig from a car..

Then, yes the next guy getting stupid I could see he was holding a 25 ounce Budweiser. But for every driving dumb ass I saw who I could tell was drunk, I saw 10 who were texting. The texting driver is just as dangerous as the drunk.
And 8 out of 10 texting drivers were female, between age of 20 and 45. These young females don't need a holster for their Iphone, they never let it out of their hand.

A couple of states had (have?) ride along programs where a cop will ride in the jump seat of a commercial truck, for the exact reason that it’s easy to look into a car. They are limited, because of the number of chase cars it takes to make the stops. The cop in the spotter truck can keep six or seven patrol cars hopping. Like shooting fish in a barrel.

I drove a lot of miles reading that thing.

Following directions,
looking at dispatches,
looking a communications from my boss,
typing in my responses.

Closest it ever came to a wreck, I was talking to another
driver on the radio while we were looking for a customer in the dark.
Turned into a side road and dropped the keypad through the spokes
of my steering wheel.

In the middle of the turn!

The damn cord tied the wheel and I couldn't straighten it.
Kinda sporty for a few seconds.

Not my brightest moment.

I figure the guy if convicted should get one year to the day from conviction for manslaughter for his appeal to be complete. No delays of any kind. If the judge lets it go more than one day over a year he has to do the time with the convicted killer. If the killer loses the appeal he gets hung on the courthouse steps at high noon the following day. No 20 years on death row. As a retired policeman told me once, everyone should have one lawyer tag a year. Be Well, RZ.

I’m guessing that since Jag resides in the Permian Basin area where this occurred, he’s seen other news stories on it that must’ve stated that the driver was texting when the accident occurred. Not hard for LEO to figure out, if they pulled the drivers cell phone records.

The little company I used to work for lost $4 million in a crash very like this one on I 40 in Nashville, one of our trucks piled into a backup and a 23 year old man burned to death in a pickup truck. Our driver was uninjured. He got 2 years in jail.

On the other hand, a big truck that gets stupid, weighing 79,000 pounds, can do a lot more damage than a Honda Accord at 4,000 pounds.

I have been diligently searching for any news report that states what the problem was with this driver. I have not found anything.

My hat 🎩 is off with a big thank you for all our great professional truckers. They are indespendsible and unappreciated. However spend some time at a few truck stops. It’s scary what’s on the road driving a lot of the trucks. I’m sure a lot of them aren’t Americans. Scary, sad , just the facts. Thanks to all the professionals!
The wife and I travel this us of america on a pair of harley davidsons every year . I can not tell you how many times we see this phone distraction bull chit !!! I have had more than a few confrontations on the road or in a filling station lot. some heated , more not . people are the dumbest f - ing thing on this planet !!! I have heard all the reasons ( excuses ) for the situations , most just bull chit lies . these f-ing phones should not be able to work if you vehichle is in motion , and that is all there is to it ! What dose anyone have to say that is so important that putting anyones life in danger for is warrented ? but our beloved guberment dose nothing realistic , we all know that we are all just prey out and about just trying to live until it is your turn ! the sooner you accept it the better it will be for the people that get to make money off our azzes !

Most cars dont run over 5 cars.

Truck was not the problem however. Problem was, little girl dies because a driver was texting according to local TV news. Driving a big rig and texting may have made it worse, even if it werent your or Deflaves little girl.
Personally, i expect had it been deflaaves daughter he would still not blame the trucker. Sure and not.

See drivers all the time on their phones, eyes on their lap driving fast, It's a lot worse in ATL.

I’m guessing that since Jag resides in the Permian Basin area where this occurred, he’s seen other news stories on it that must’ve stated that the driver was texting when the accident occurred. Not hard for LEO to figure out, if they pulled the drivers cell phone records.
