I just don't think she'd sit on anything super incriminating this long - knowing the eventual end game.

1. Does a Fed judge have the authority to order the recovery of data? How and with whom?

2. Does the Fed judge have the security clearance necessary to read the emails? TS/SCI - not likely

3. What's to prevent some 3 letter agency wonk from finding his own federal judge to shut this whole thing down - in the name of "National Security" due to unsecured classified info and nothing happens to Hillary?

I am of the opinion that State Dept WAS involved with F&F. A US Attorney would be crazy to have a cross border operation without State Dept involvement. Getting a judge mad enough with your shenanigans that he sent Johnny Law to get your stuff, is a fairly big deal considering that the litigant was private and not a government entity.

Are the Clintons devious enough to have staged all of this. First, they set up a private email server and run all of your (and your senior staff's) email through it. You know that it will likely be a liability, so you let the word come out about the servers existence, but only after it was been wiped clean. Lots of sound and fury occurs, and finally a judge says let's take a look. Meanwhile the tension builds (as in this thread), with heightened expectations that finally the Clintons have gotten caught. Then, after a whole raft of alphabet soup agencies have taken a look, along with the non profit plaintiffs and no smoking gun is found - Hilary sails forward to claim the D nomination with the exclamation - "See, they all looked and nothing was found - it was all a vast right wing and left wing conspiracy."

You can bet yer sweet bippy it's "after"..

They have been running Boot and Nuke ( or any other DoD approved sanitizer ) on that server 24 / 7 since the server story broke.

I would really be pleasantly surprised if they are able to pull anything from it.

Charles Krauthammer told viewers Tuesday on “Special Report with Bret Baier” that revelations classified emails were found on Hillary Clinton's private server that she used to conduct business showed that “it’s not only her trustworthiness, it’s the fact that nothing she says ever is true three weeks later.”

On Tuesday, the Intelligence Community Inspector General informed Congress that two of four classified emails found on Clinton's personal server carried a “Top Secret” classification – one of the highest security categorizations.

Clinton has repeatedly denied using her private account to send or receive any classified emails. On March 10 she told reporters “I did not email any classified material to anyone on my email. There is no classified material. So I'm certainly aware of the classification and requirements and did not send classified material.”

Krauthammer, a syndicated columnist and Fox News contributor said that Tuesday’s revelation is simply part of a larger pattern of behavior by the former secretary of state: “She says ‘there was nothing classified and I know how to do that, I know the process,’ and then it was revised to ‘nothing that at the time was classified.’ Well, now we’re learning that it is quite probable that actually at the time it was, and she should have known it even if she’ll claim, obviously, that she didn’t.

“There’s always a movement, a parsing of the edges, a cutting, with her husband, and with herself and that is the problem that dogs her and that she cannot escape.”

This is my take on it as well. I have ZERO trust in any branch of the government to do the right thing. My guess is they will hold onto this until the right moment then release a statement saying "Hillary was right, all we found were her Yoga appointments". Even without the server, they had TONS of reasons to indict her, yet nothing happened. While it is true Obama hates the Clintons, the only way I see her getting nailed is if the bottom falls out of her in polls and a suitable replacement is found, and Sanders is not it.
