"....try to keep folks from harm?" That's certainly true as far as it goes. However, the Marshall was trying to keep the witness from harm as well and I doubt she (pretty sure the Marshall was female) could tell if he had a pen or a knife during the incident. Further, give just about anyone with malicious intent, and a minimum of knowledge of human physiology , a Bic pen and you could easily end up with a Bic pen in a carotid, throat, brain stem, etc. Deadly force was absolutely justified.
