I've changed my mind on this one. Everyone is missing the point: she is relying on Kentucky's religious freedom statute which could easily provide her a defense. The statue protects persons from being required to perform acts contrary to the their religious faith unless the refusal to perform unduly burdens the rights of another person. The homos could get licenses in other counties. Arguably, there is no undue burden.

Its hard to believe this is even a discussion.


What every one is missing is that Davis is relying upon Kentucky's religious freedom statute. No one has analyzed her actions in light of that statute. If her actions fall within the ambit of the protections provided by that statute, then she has violated no law and cannot (properly) be found in contempt.
You can't automatically conclude she is wrong without first analyzing the issue in light of the law she is relying on for her defense. No one here has done that.
