I've changed my mind on this one. Everyone is missing the point: she is relying on Kentucky's religious freedom statute which could easily provide her a defense. The statue protects persons from being required to perform acts contrary to the their religious faith unless the refusal to perform unduly burdens the rights of another person. The homos could get licenses in other counties. Arguably, there is no undue burden.

So when a future SCOTUS determines that there is an individual right to be free from fear and that a federal program giving money to the states for a national gun registry maintained at the county level throughout the states is consistent with this right, I assume everyone here will be consistent in their admonitions for the clerk to "just do her job" and equally supportive of the right of the federal judiciary to dictate to county and state officials as to the duties and requirements of their jobs. Very good point! And notice that no one was criticizing the Attorney Generals of California (and various other states) when they refused to perform their constitutional duties to defend their states pro-hetero marriage laws.

If you are a GOVERNMENT employee and your job is to issue permits and licenses to those lawfully in pursuit of them and to record legal documents, and you refuse to abide by the legal requirements of your job, even to the point of refusing to perform those lawful tasks under court order, you damned sure will be jailed for contempt.
Her job, the one she wants to keep and keep the pay and benefits from, requires her to issue GOVERNMENT permits and licenses and to record legal documents. That's it, and that's all. If she finds that too onerous, she could and should step down. To refuse to perform that GOVERNMENT job and still want to keep all the pay and benefits is contempt and downright theft of taxpayer funds.
When folks decide they want a damned government clerk to be able to decide - on their own and based upon THEIR beliefs - whether or not the person or people before them can receive the lawful government permit or license they seek, we've lost our damned minds as a free people and are one huge step closer to a third world schit hole where bribery and coercion at every level rules over the the rule of law. ^^^^^This and end of argument^^^^^^ She's a nut-case and shouldn't be deciding anything but where her stamp goes on the document. Its hard to believe this is even a discussion. What every one is missing is that Davis is relying upon Kentucky's religious freedom statute. No one has analyzed her actions in light of that statute. If her actions fall within the ambit of the protections provided by that statute, then she has violated no law and cannot (properly) be found in contempt. You can't automatically conclude she is wrong without first analyzing the issue in light of the law she is relying on for her defense. No one here has done that. Jordan

The litigants could have easily applied for a Writ of Mandamus in the circuit courts right there in Rowan County. Unsurprisingly, it is a fairly common occurrence as that county clerks and other county officials are often stubborn on a variety of issues and/or have differences of opinions as to what they are supposed to do. A litigant can ask for a Writ of Mandamus. The clerk gets her pee pee mashed. And likely loses the next election. If after said pee pee mashing she still refuses to follow the writ, she can then be held in contempt and fined or held in jail BY THE STATE COURT. She was told by three different courts to comply, and she still refused. She got what she deserved, and likely will be jailed again when the attention starts to wane.
One shot, one kill........ It saves a lot of ammo!
