250 parking spots at the ranch supply store, and these two wankers have to fight over one.



"A parking dispute outside of a south Kalispell retail outlet sparked the Sept. 27 shooting that left one man hospitalized with a gunshot wound to the abdomen and another man facing a felony charge, according to newly filed court documents.

Prosecutors filed an assault with a weapon charge against John David Walker, 70, of Dayton in Flathead County District Court on Sept. 29, two days after the shooting near U.S. 93. Kalispell Police officers, responding to reports of an assault involving a weapon about 4:30 p.m., took Walker into custody at the scene, according to a department press release.

The victim, who was hospitalized after the shooting, told investigators that his discovery of a red truck parked in the handicapped ramp of Murdoch’s Ranch and Home Supply sparked the incident, according to an affidavit filed in district court. He approached the owner, identified as Walker, and the two exchanged words, court documents said.

After the words turned to expletives, the victim allegedly shoved his shopping cart down the ramp. It came to a rest against the bumper of Walker’s truck, court documents said.

Walker drew a gun following the collision and leveled it at the victim, court documents said. In response, the victim allegedly struck him in the head and Walker fired the gun.

Officers arrested Walker after arriving in the parking lot, taking a loaded magazine from him, and initially took him to the Kalispell Police Department, court documents said. Making a phone call at the station, Walker said he had been arrested for shooting in self-defense, according to court documents.

One witness recalled seeing the victim punch Walker prior to hearing two gunshots, according to court documents. Another witness told investigators he saw Walker shooting toward the parking lot. Walker surrendered the weapon upon his request, he said, and asserted he fired after the victim swore at him and struck him, according to court documents. That witness also spoke with the victim, who acknowledged striking Walker, court documents said.

Walker, who is being held in the county jail with bail set at $20,000, is expected to appear before Judge Dan Wilson for his arraignment on Oct. 5. Assault with a weapon is punishable by up to 20 years in Montana State Prison and a $50,000 fine."

I think in Kentucky the guy that got shot would have a got a "well that's what you get for phuggin around and punching someone" lecture from the cop and the shooter would be home eating a TV dinner

Dipshidt #1 wasn’t even in a parking spot. He was parked at the ramp where you can push your cart from the store to the parking lot, blocking it. Dipshidt #2 comes out with a cart. Words were exchanged, alleged fists were thrown, and Dipshidt #1 shoots Dipshidt #2.

Interesting aside, Dipshidt #2 was armed as well and didn’t return fire for whatever reason. Thankfully

We loved Kelispell, stayed there probably 3 times, but been 6 years since we have been there, imagine it’s full of Yankee Californian we’re special a holes now, sounds just like any self defense case should be, especially when he didn’t hurt other guy when he shot him.

Depending on who's doing the punching, I might be shooting them myself. Us older folks can, and have, been killed by punches to the head. Old brains don't recover like young ones do. I'll not let a young punk beat me to a pulp, especially if I'm outnumbered. So, this old curmudgeon would draw down in the right circumstances....

Looks like the victim brought the shooting on himself. Not sure if the clean hands doctrine applies here. His right of self-defense may have been made imperfect if he was actually parked illegally in a handicap spot. Not sure, though. Absent that, looks like a good shoot. Are we required to engage in hand to hand combat with anyone who chooses to attack us with their fists? I don't think the law requires that.

A Youtube prankster got shot recently because he was acting like a dick. Sounds kind of like what happened here. You never know what might happen when you get up in someones face.

That Jan 6 attorney who stabbed a dude after a fender bender (I think) is another example. It might of just been a case of road rage. I don't remember for sure.

I think the fault lies with the store.
If there was no store, there would be no need for these fellas to be there.
This: no argument, no fight, no shooting, no paperwork for the police.

Sounds to me, there should be some picket lines and protesting.

So you shove a cart, then approach someone - guy draws gun and you start punching THEN get shot. You deserve to get shot. At worse, charge the shooter with brandishing.
