I had a friend who got charged for DUI in a small town in SE Alaska during the 4th of July celebration. A couple of morality Karens with a bone to pick with him over other matters called the cops, said he was drunk and driving after seeing him at the bar.
He had his car turned off and parked and was taking photos of the festivities from a dock. Cop shows up and starts asking him questions and then gives him breath test which he passed! Didn't matter, the cop who never saw him drive or operate or in the parked car that wasn't running cited him for DUI.
He got out of it but it cost him a lot of time, money and headaches.
I told him his mistake was talking to the cops in the first place. He should've shut up, not answered any questions and not performed any tests.

True. But that's if you are operating a motor vehicle or involved in an accident in one. The motor vehicle in this case was a non-running, unoccupied parked car and the cop did not witness him driving or exiting the vehicle.
