My old stepdad used to tell about how his father had shot a man for stealing chickens. It must have occurred back in the 30's or about that time. The extent of the legal ramificaions are as follows.

Sheriff: What ya shoot him fer?

Harold's dad: He was stealing chickens.

If the two morons had not broken into the house with the intent to steal...THEY WOULD NOT HAVE BEEN SHOT. This was a brazen, daylight FELONY act...committed by two illegal alien FELONS...that was confronted by a man with a legal and moral right to stop them.

I think you misunderstood what I meant. What I meant was simply that money and property can be replaced. I am much more comfortable with force being used to protect someone from immediate danger such as shooting a burglar inside your own home or who is trying to break in (not afterwards) since you do not know the intent of the person attempting entry, shooting a rapist, etc.

To be serious for a moment (rare for me) I think you are either missing of seriously dicounting an important factor..Rage...
Sitting comfortable at home discussing the moral aspects of the subject is one thing. Sheer killing rage at having some low life take your valuables is something else.
I know my temper and go far out of my way to avoid confrontations but I can see myself doing what Mr. horn did.

Can't you shoot fleeing felons in some states? You can't in N.C. but, unless I am greatly mistaken, you can in Florida. It sounds as if the Texas laws are set up to give more protection to those who obey the laws than to those who break them.

I can't agree more with what someone said ... regarding the "value" of money/property that someone is willing to steal from your home, being equal to the value of their life. If all they want is a cookie, then THEY have determined that their life is merely worth a cookie.

The point is, you do NOT break into anyone else's home, for any reason, period. The moment you do, you are putting yourself in harms way. I can't see how that's hard to understand.

And as far as a thief posing an "immediate life threat" or not ... how the hell can you know? It's almost like playing Blackjack - where you have to assume that the 'hole card' the dealer has is valued at a 10 ... Same with someone breaking into your house ... you MUST assume that they are there to steal what they want, and deal with you in any way they see fit to accomplish their task. The fact you may or may not see a weapon, or think that they might not want to harm you, is just asking to have your life ended.

That saying is one I'll never forget, as it applies to just about everything in life ...

No, I am not discounting rage. Trust me I am familiar with being angry enough to want to personally shoot every last SOB in an area (before anyone freaks about that, it was related to a good buddy -our medic- getting killed during an ambush).
This isn't really going to go anywhere so its probably just best to agree to disagree on this.

eschuh, You mentioned that in your book, someone inside you house would be shot. It is, however, not your book that really counts. It is the laws on the books of the state that count the most.

According to the folks who taught my concealed carry class about a decade ago, N.C. gives the same protection to someone inside your house that it does to someone outside your house or someone on public property. The person who is actively breaking into a house is the easiest one to shoot legally. Make sure he falls halfway in the door. N.C. also has no citizen's arrest. A thug who breaks into your house, kills a family member, and then runs is protected by the law from deadly force.

I think those laws are crazy but know my opinion would count very little if I were hauled into court for blowing away a maggot.

(I am not a lawyer and don't play one on TV.)

In Illinois its pretty much as you said (which what I had said back on page two -top of the page). If they are in the house they are fair game, once they leave (if they are not continuing to be an "active threat") shooting them is not wise. In Illinois the key to self defense is that you are acting to prevent immediate serious bodily harm.

Someone inside your house is not fair game here in N.C. Laws are different in different places. Mr. Horn's actions were judged to be legal in Texas but might not be legal in other states.

In Colorado, if someone is in your house and you fear for your safety you can punch his ticket.
A recent case a couple of years ago in a nearby town, someone actually killed someone outside his house and the local DA ruled it "close enough"
