May Day Melee Gravy Train Continues

Thursday, June 10, 2010

By Walter Moore - Attorney

Remember how Villaraigosa and the City Council handed out $12.85 million of your money to settle claims arising from the May Day Melee?

Well, the fun hasnt stopped.

Now City Hall plans to hand over another $500,000 of your money to people who refused to leave McArthur Park when the police ordered them to do so.

This was on May 1, 2007, when people attending the rally to support undocumented immigrants knocked a police officer off his motorcycle, and started throwing frozen water bottles, rocks and other projectiles at other officers. Villaraigosa was hiding in Mexico at the time. LAPD Chief Bratton was also conveniently out of town, even though May Day always involves huge protest crowds in this city.

The half million dollars will be handed to five journalists and a Telemundo security employee who failed to get out of the way.

If I were Mayor, I would take these cases to trial, not spend half a million dollars of taxpayers money to settle.

Then again, Im old fashioned: I would only use City Attorneys to represent the City in litigation, as opposed to lending them out to assist MALDEF and the ACLU in other peoples lawsuits in Arizona. Perhaps there is no one left in the City Attorneys office to represent the City itself in court.

In any event, the City should take these cases to trial and hammer away at three issues:

First of all, these plaintiffs could have and should have gotten out of the way. The police clearly told everyone to clear the park. The overwhelming majority of the people in the park that day complied with the order. And the order was reasonable. After all, a riot was underway, and the best way to stop it was to get everyone out of the park, rather than letting the bad guys use the crowd as a human shield while attacking the police. Do we really want to start rewarding people for disobeying police orders during a riot?

Second, the City should contest the actual damages these people sustained. One of the six plaintiffs is getting $250,000, so I assume he at least actually sustained some serious injuries. The other five, however, are each getting $50,000. Do you think they actually sustained $50,000 in damages, or did someone just arbitrarily decide thats a reasonable figure, and lets just sweep this under the rug and move on? I want to see some medical bills, lost wages, etc. Youre not entitled to a new Mercedes just because a cop shoves you when you refuse to get out of the way.

Third, the City should try to distinguish between the conduct of the City itself, on the one hand, and any officers who supposedly used excessive force, on the other. Presumably the City trains its officers on using reasonable force, and has guidelines on that sort of thing, and takes disciplinary action against officers who violate same. If, despite all that, someone decides to go rogue, that person, rather than the Citys taxpayers, should bear the burden.

This fiasco -- namely, giving away over $13 million to people who refused to comply with a lawful order -- is yet another example of the gross mismanagement of Americas second-biggest city.

The Philosopher Kings of Spring Street need to spend less time worrying about Arizona, Guatemalan murder investigations, American foreign policy, etc., and more time doing the job theyre paid to do: manage the city.

If I go ride the bus and get sick because of all the germs, can I sue for damages? Those buses should be sanitized at least daily. I uh, was going to drop off a job application two days later for a job that paid $250k a year. Because I was sick from the germs on the bus I wasn't able to drop it off and didn't get the job. Now you, the city, owe me $250k a year plus full medical and dental!

Wait a minute, I'm probably giving some POS an idea to try.

"They didn't comply with a lawful police order?" For that reason alone they should have to prove injuries in court. And even then it should lower the award very severely.

I renewed my Oregon drivers license the other day. I had to do several things, eye test etc., I was asked "Were you born in a foreign country?" I answered "Yes" this caused a great sucking in of breath. Then I added "In Los Angeles" Several of the customers and staff laughed, including a couple of Hispanics.

They sure have a better sense of humor on your side of the State than they do on this side of the state...

Los Angeles isn't a foreign country.. just the political machine that runs it is anti American.. there is a big difference..

I really believe that the liberals of my generation, are playing their Swan Song right now in the this country.. their leftist ideology is being seen thru at this point..

I've always maintained, it will take 40 to 50 years to erase the effects of the Hippie Generation in this country.. but world economic and military situations, courtesy of Radical Islam and the control of energy world wide, is going to undermine everything they have built on the last 30 plus years..

I'd be more inclined to go ahead and ASK,.....very clearly, for a "Line of Demarcation" around the damned place.

Antonio Villagurosa's a KNOWN traitor, and is apparently endorsed by his "Constituency".

....Play those games, win those prizes.

No power, no water, no Greenbacks,.....FUGGIN' NADA,....you (L.A.) just "Resigned" from the USA....and we're going to keep you at arm's distance.

ARMS,....get it ?

How about this?

Starting today, you get your camera out.
Start taking photos of all of the wonderful things you have going for you in North Carolina, you know all of the over the top natural wonder, your hunting & fishing conquests and the natural beauty etc...etc...

I'll do the same here in the armpit, sh*thole you call the PRK.
January 1st 2011, we both come to the fire and put up a photo fest.
Then either dude can run their mouth as to which guy has a better life in a better place.

Up for it big man?

Didn't take long.

Awfully defensive, aren't you? Methinks you do protest too much, as likely a nerve was struck with the OP. Funny, that all I said on this one was I wonder who long it'd take one of y'all to show up and start whining. Should have given an over/under...

And, I ain't much on NC, either, yet I don't see nearly the amount of undermining of America from NC that even a blind man can see from the PRK.

So, I'll pass... simply because I'm not the one with something to prove nor to disprove.

Have fun out there, though... while your leftists allow you do so.

The top 7 pics look great; lots of fun, and beautiful scenery. Bravo.

Roy Rogers was a classic American icon; can't think of anyone who'd fault that.

Haven't a fuggin' clue what that last pic is of, but if you're taken by them, well, have at it.

Never said you didn't have beautiful scenery out there, nor opportunities to enjoy yourselves (well, as limited by your leftists...), simply that the PRK is currently undermining the U.S. to a degree unfathomable by folks like Roy Rogers, and the reputation it has for being an anti-American, socialist breeding ground and fundraising mecca is well deserved. Not even the most ardent PRK-advocate can refute those facts.

Simply put, the mess is in your backyard, and it's contaminating ours. Until y'all get it cleaned up (your backyard, remember), expect to get little support and a lot of vitriol. Facts, are facts.

Born and raised in Los Angeles. The place is aggravating in every respect. It'll continue to reap what it sows. Much of urban Southern California is about as bad. Northern California, however, is a totally different vibe, and still has much to recommend it.
