since you can't prove the address owner was the user who infringed. if upheld this will be a kick in the teeth of internet copyright infringement suits:

I liked the judge's statement that the bittorrent mass lawsuits are a waste of judicial resources. Well...d'uh. Yeah.

How do you think they caught the guy that tried to extort money from Bill Gates a few year ago he didn't leave a phone number.

This is a common sense ruling and should be welcomed IMO.

Tying someone to an IP address, without further proof, is asinine.

Anybody could be using a given IP address.
They would have to prove who was logged on the machine at the time. They'd also have to prove that no one broke into your machine, especially if you have a wireless router on your network.

IP address isn't even that good for identifying a machine, since it can be spoofed.

Steve,

Do you think that using the same reasoning would apply to red-light cameras?

This is a very good common sense ruling. Anybody could be using your IP address, for any reason, say for example, a couple of kids break your passwords and fake your death.

EVERYBODY is pro-gun, some just don't know it. When an anti-gun person is in trouble, the first thing they do is call 911 and demand that they send somebody with a gun!

From a cursory look at it, the ruling seems to hinder prosecution of libel/slander actions,as well.

Mebbe a rusty knife or a barrel to suck on. The old [bleep] will be worm food soon anyways. Nothing to live for. She has never done anything with her life but dream and troll. The old girl is a washed up has been never was. She sits in her rocking chair looking back on her sorry existance and the cruel misfortunes of her life. She is forced to suffer her last remaining days in the turmoil of having gone so wrong oh so often.

Enough to cheer the casual observer right up! We are blessed to be fortunate to watch her crash and burn.

Better days ahead sugarbritches!

Yes a common sense ruling, but it may have some serious ramifications in cases where folks have used computers and the web to commit fraud.
