A judge could order his release if he so chose. And it happens. The fact that he has not been released is one of two things. Either there's more to this than the story says, or the system is completely failing this prisoner. Either could be true. I suspect the former.

If I were the judge I would put the Cali AG in jail for violating my order! I didn't read that the judge ordered his release. Just that the conviction wass overturned.

Your missing the germain point, the State is appealing the judges ruling - like it or not that is the States Right, just as it was the inmates right to appeal his original conviction.

yep, it's still on appeal, based on his allegedly untimely federal habeus petition.
one might also note that the fact that two witnesses now say they didn't see him pitch a knife, assuming they're accurate, simply means they didn't see it, not that he didn't do it. Angle, visibility, timing, or any number of factors could account for that.
he may yet beat the rap, but he ain't there yet.

Why is Leonard Peltier in jail - I believe he should be free - maybe the only good pardon any President would issue is to free that man - the FBI had no business on the reservation harassing AIM.

AIM came to California and harassed a lot of the white people that owned teepees, threatened to kill them because the teepee was and Indian religious cultural thing and whites were not allowed to have them and they took some of them from the whites when they left the camps and told the camp members that when they came back if any whites were there with teepee's they would kill them.
AIM nothing but bastids as far as I am concerned
