Our local sheriff is holding a gun buyback program Saturday. He says that the the program allows people to safely dispose of working firearms in exchange for cash with no questions asked. I guess that means that criminals can sell stolen guns with no risk of arrest.
It is against the law to knowingly buy stolen property. Is it also a crime to deliberately ignore the probability that the item is stolen? Doesn't the sheriff have a legal responsibility to return a stolen gun to the rightful owner?

I think the sherrif has a legal responsibility to return any stolen gun (property) to the original owner. They should run the numbers on all the guns after the buy back and return any guns with serial numbers that were reported stolen to the original owners. Believe it or not I have know of several instances where this has happened. The guns were not obtained specificly thru a buy back tho. In one case it was almost three years after the gun was stolen that it was returned.

The term "buy back" is erroneous, in that you can't buy "back" something you never owned.

This could get interesting. Under the proposed legislation EVERY gun sale must have a background check. How will this work?

The rules only apply to us. If the law says every gun sale must have a background check, they'll ignore the law when purchasing these guns. If the law says the stolen guns must be returned to their owners, they'll ignore that too. Call me cynical.
