Essentially from what I can read SCOTUS has said the federal government must recognize all marriages that are legal in a state.

I do not agree with same sex marriage but I also do not agree with a federal law trumping a state's decision.

I'm guessing they will uphold California's proposition 8 now.

I think the State's Rights issue is what caused them to rule the way. Say what you want about this SCOTUS, but they have made some currently unpopular decisions that actually limit Congress and the Feds power to make the States bow to their wishes.

Ed Not that it matters as the administrations justice department will tie them up in litigation.

I am somewhat confused from the initial reports.
Will Virginia have to recognize deviant unions when Vermonters move to the Old Dominion?

Do we have to sleep in separate beds, too? It depends how big it is.

Initial reports SCOTUS has struck down DOMA in a 5-4 decision. And they struck down CA Prop 8. So much for the court being reticent to meddle in state issues. The court really doesn't have any morality. They are unable to differentiate behavior from states of being. On the bright side, it might be the perfect time for alcoholics to stand up and demand their right to be drunk.

The prop 8 ruling of course only applies to California's situation, and all it really said was the the defenders of proposition 8 didn't have standing to appeal the trial courts ruling.
