I have an older stainless M70 in 300 WSM . I want to mount a 3.5x10x40 VXIII on it. Can I use extra low Talley LWs or should I order the lows?

I order the lows on my M70's and they work perfect. To be fair I have not tried the extra lows but they may have clearance issues with the 40mm.

I've got extra lows on a LA Model 70 FWT holding a 6X42 without an issue.

Here is a photo of a Burris 3-9X40 in lows on the same rifle. I'd be afraid to go much lower.

They just want constant reassurance that what they believe is the truth.

Extra lows will work. I would go that route.
