As an IT guy, it still doesn't hold water.
1) Hard drive crash
-- Happens, and is believable for 1 person.
-- But NOT for 7 people in one year all involved with the Tea Party harassment.
2) Hard drive recycled
-- Expected. Why would ANY organization save a dead hard drive for 3 years? Not an issue.
3) Server backup tapes reused/overwritten
-- Almost assuredly true and normal.
4) Emails not recoverable
-- NOT believable to me!
Why?
a) If her hard drive crashed, her emails were still on the email server at that time. Emails in any modern organization aren't stored locally on laptops/computers, a copy may be kept there for quick access but the "original" of it is kept on the email server.
b) So, the emails had to have been deleted off of the email server as well in order for them to disappear, otherwise they would have just synced back down to her new laptop with no loss of data.
On another note, the IRS claims that their criminal forensics team tried to restore the hard drive and failed. If this is true, surely there is documentation and emails and a report from the forensics team as to the state of the hard drive and how it likely failed. Subpoena the emails for those and get the forensics people to testify. Since these are forensics law enforcement agents, it's going to take a LOT of pressure to get them to lie to Congress, I would think. If they are caught, then every time they walk into court in the future the defense will bring up the fact they've been caught lying under oath before.

It's the government.. if time was spent by the criminal forensics team in trying to recover it, there is a trail as to who worked on it. I just got done working with a federal computer forensics agent, they document EVERYTHING.

However, when you control the Justice Dept, you control everything. They simply won't prosecute.
