Federal Court Blocks Texas Voter ID Law, Calling It A 'Poll Tax'



WASHINGTON -- A federal judge in Texas struck down the state�s voter ID law on Thursday, calling it an �unconstitutional poll tax� intended to discriminate against Hispanic and African-American citizens that creates �an unconstitutional burden on the right to vote.�

In a 147-page opinion, U.S. District Judge Nelva Gonzales Ramos, an appointee of President Barack Obama confirmed to the bench in 2011, ruled that the law passed by Texas legislators and signed by Gov. Rick Perry (R) took an �unorthodox� approach they knew would have a disparate impact on minority voters. The law requires voters to produce government-issued identification before casting a ballot.

While Ramos found no �smoking guns� of racist intentions in passing the legislation, she said the state legislature's 2011 session was �racially charged.� She concluded that the sponsors of the measure �were motivated, at the very least in part, because of and not merely in spite of the voter ID law�s detrimental effects on the African-American and Hispanic electorate.�




A spokeswoman for Texas Attorney General Greg Abbott said the state would "immediately appeal."

A panel of judges previously shot down the state's request to implement the law on the grounds that it posed �strict, unforgiving burdens on the poor.� But Texas was allowed to move forward after the U.S. Supreme Court gutted a provision of the Voting Rights Act that had prevented the state from implementing voting changes without permission from a court or the federal government due to the state�s history of racial discrimination.

Ryan P. Haygood, an attorney with the NAACP Legal Defense Fund, said in a statement that the Texas law was "a problem in search of a solution," pointing to the lack of evidence that in-person voter fraud is a significant problem.

�The evidence in this case demonstrated that the law, like its poll tax ancestor, imposes real costs, and unjustified, disparate burdens on the voting rights of more than 600,000 registered Texas voters, a substantial percentage of whom are voters of color," Haygood said. "That result is precisely what the Voting Rights Act was enacted to outlaw."

I would absolutely love to ask a liberal progressive "Why are people of color so hampered in securing an ID?"

Aren't we all created equal?

Is there something in the genetic makeup of minorities that's reduces their capacity to function in society and accomplish the basic task of getting an ID?

They did the exact same thing here in NC but the State Supreme court over ruled:

The entirety of North Carolina�s sweeping voting law, seen by many as the strictest in the country, can go into effect for the impending midterm elections, the Supreme Court ordered Wednesday.

The Supreme Court�s move clears the way for the elimination of same-day voter registration and bans the counting of votes cast in the wrong precincts. An appeals court put a hold on those two provisions last week.


Our voter ID portion goes into effect next year. It will be a furball before everything is settled.

One needs photo ID to do almost anything: cash a check, board a plane, make a purchase with a credit card, apply for welfare, and more. So who exactly is it who wants to vote but doesn't have an ID? Might they be people not entitled to vote?

The US Government REQUIRED Iraqis voting for THEIR President to dip their finger in Indelible ink to prove they only voted once. But we can't even REQUIRE our citizens to produce a valid ID to vote? REALLY!?

Why aren't there protests down at the Quickie Mart? You can bet there are signs posted inside stating that ID must be produced to buy cigs and ripple.

So she blocked a law because she said an entire session of the state legislature was "racially charged"?????

Time to impeach that judge.

They ALWAYS ask for my ID in TN, no crying or excuses. You have to be on their little roster thingy, you have to have a goddamm official issued ID or you can't vote.

In a nation mixed with illegal non-citizens, why is it encroaching on anyone's rights to have citizens prove they have the right to exercise their vote?

It seems that they would be proud to prove that... And also seems that the only ones that would be offended are those that are NOT citizens, and have no right to vote anyway.

The main reason the libtards struck down this law is because the poor and uneducated generally vote dumacrap. If they can't vote because they are too lazy to get an ID, the dumacraps will lose all their voters

I have a major issue with the selective application of requiring ID to vote.

If it's good for one state, why not all???...........the abilities of minorities in all states should be equally able to get ID if they really want it.

This is a fugging joke perpetrated on the American people by an overreaching AG & the justices have got their collective heads up each others azzes.
