Don’t we have laws about how immigration is supposed to happen? How can the executive branch unilaterally circumvent these laws.
The circumvention comes from the fact that they know there is not enough detention space. The invite is put out, they arrive, and we (the collective we, as a nation) immediately run out of space.
The result is serving the individual with a Notice to Appear. That Notice to Appear gets them off the border because until that court date, they are here legally.
Once they get to their destination they know they are home free because immigration enforcement does not have the capabilities to go forth and get them all.
The only hope is that another Trump comes along, and goes back to doing everything he did. The vast majority will be removable/deportable down the road.
