I think it was an appeal to a 3 judge panel on the 6th that the AFT lost.

The enbanc panel (16 judges) at the 6th heard the 2nd appeal and split the decision which upheld the original decision which the ATF had won. Link above.

To be appealed to the Supreme Court.

From what I've read this is my interpretation also.
