If Obama is allowed to make this appointment, the 2nd A as we know it will be gone, as in really gone.
Besides mountains of regulation, could possibly even go to attempted confiscation.

My guess is that Obama will nominate a minority judge and then the Dems will claim that the Senate won't confirm the person because the Republicans are racist. This would give them an issue to help mobilize the black vote in November. I don't know if the GOP leadership in the Senate is strong enough to resist something like this.

My guess is that Obama will nominate a minority judge and then the Dems will claim that the Senate won't confirm the person because the Republicans are racist. A note off to my senator... Don't u dare vote/pass any judge of Obama's!!😈 Little hope for that here with Patty Murray and Maria Cantwell!!!  I swear we have the worst Senators of any state.

Hopefully the Senate can delay any proposed replacements until a new president is elected. (snort) HAH.. They'll rattle sabers, bark and growl and then ----- pass whoever the ACIC recommends.. Hopefully that will be a conservative. It'll be a flaming liberal and within months the Second Amendment will be history.. We are truly phuqued..

He can nominate, but the senate has to confirm. Going to get real heated. If they chose not to hold hearing, nothing will happen. Then they have to get a vote. Reid rule say SCOTUS noms need to get past 60 votes.
They're now going to be hung on the own petard.
Going to be pay back for Bork.
I really hope he nominates Holder and this thing gets drug out for months nthen is not confirmed.

The senate won't recess until the new President is sworn in, I'm betting.
