I would guess that was tweeted in response to the anonymous NYT op ed that was published today.

I think it was in response to the NYT article on Whitehouse Insider.

You can find the UCMJ online, Im pretty sure. It was written in the ‘fifties, I believe, and replaced the old Rocks and Shoals which governed the Navy and Marine Corp and also the Articles of War which governed the Army. ( I’m not positive about the Army regs )

At the start of of the document you will find who falls under its jurisdiction, and I don’t think you can show where it applies to civilians.

At first glance, yes, it would appear so. But there are often double meanings in his tweets, i.e. "Witch Hunt."

Is HRC a witch? Does evidence exist that she belongs to a coven?

The US is at war already. We have the War on Terror, the war in Afghanstan, the War in Iraq, the War in Syria, the war in Libya, etc. Iran is officially a supporter of terrorism. These countries and others already have EO's declaring them to be national emergencies.

I think anybody the would be the subject to the (new) rules of a courts martial, would first have to be subject to punishment under the UCMJ. Which is not civilian citizens.

The key words being "Any person SUBJECT to this chapter..." (Meaning any person subject to UCMJ. (Military))

Reading the Espionage criteria sounds like any and all things folks in the military would have their hands on.

(I also asked about those Annexes in a post pages back, because it implies it will list those who are subject to these new EO's. That would clear things up)
