He was no longer reasonably in danger. Murder, at least man slaughter. Temporary insanity plea, feared for his life in his dazed and confused state .... wasn't in his right mind after being sucker-punched. Might have suffered a concussion from the vicious unprovoked blow to the nugget. exactly , fight or flight response . everybody is different.
