Welllllll, technically he isn't President, but instead is the Commander in Chief. I know, the President is the Commander in Chief, but there is a bit of a difference. If the War Powers Act was inacted, then there is a declared war, then the President is no longer the President but the CIC until the War is over. Since the War isn't over, Trump is still CIC, but Biden is not President. It's a fine line I know, but there it is. A CIC can also Federalize the National Guard and put them under the CIC command. They stay Federalized until the threat is gone or the CIC rescinds the order. Neither has happened so the National Guard are still Federalized and Trump is still the CIC.
Because Trump is CIC, the Military at the moment has jurisdiction in all things domestic. Call it Martial Law if you want, but it is not quite although the Law of War Manual is in affect along with the other War Powers manuals. Under the Continuance of Government the CIC or President can move the Capital to another designation area for the safety of the Government. Washington DC is in the hands of a foreign entity so therefore the US Government is not safe in that location. Trump moved it to Texas.
