The few times that I have been checked, the Warden used my shells to see if he could fit more than two in the magazine. If the shells that you are using will allow more than two, you will most likely get a ticket. miles


Look out for number 1, don't step in number 2.

Nighthawk, I think that's the way it's interpreted and enforced by many, and that approach is reasonable. The law doesn't really differentiate between different lengths, however, and it's all about "capability". That's why I'm curious to know if anyone has ever been charged for having a shotgun that is capable of holding three 2 3/4" shells. I'm afraid there may be a few bad officers out there (and judges) that could charge and convict you for having a shotgun "capable" of holding three shells.

The first couple of years of manufacture the SBE would cycle with one in the chamber, two in the magazine, and one on the carrier.

Later years thay fixed that but does anyone still get ticketed?

There's that, plus here in SD a few good conservation officers just weren't in sync with the interpretation from headquarters on an ambiguous regulation. I e-mailed Pierre for clarification and carried the response with my license for a few years.

I'd argue that the regulation was intended to limit me to three shots and that's what I'd get with the shells I had but you never know. Remember all the hoo-ha over what constitutes a baited field before FWS "clarified" it.
